| With the vigorous development of the construction industry,the number of construction projects is also increasing,and the number of construction contracts is also increasing day by day.However,due to the long-term nature and complexity of the engineering project and the uncertainty of the external environment,engineering claims have become an important issue that the owners and contractors must face.If the claim problem cannot be resolved in time,it will evolve into a more violent dispute,destroy the cooperative relationship between the two parties,and affect the smooth implementation of the project.Negotiation,as an important method to solve the problem of project claims,is also the primary method,which can save time and economic costs,and is conducive to maintaining the cooperative relationship between the two parties.The result of the negotiation is not only to solve the past problems.Is more about the continued performance of future contracts.Therefore,it is particularly important to strengthen the research on the influencing factors of the engineering claim negotiation effect,so as to improve the negotiation efficiency,obtain good results,and promote the future cooperation between the two parties.This paper firstly defines the meaning and quantification of engineering claim negotiation effects on the basis of existing research on engineering claim negotiation efficiency and negotiation results.secondly,based on the negotiation research results of other fields,combined with the characteristics of engineering claim negotiation.The factors affecting the effect of project claim negotiation were identified and analyzed.The 15 identified factors were divided into four categories: negotiators,business relationships,negotiation process and project environment,and analyzed the relationship between the secondary influencing factors using the explanatory structure model.The internal correlations lay the foundation for the construction of the structural equation model of the influence factors of the engineering claim negotiation effect.The theoretical model of the influence of the four types of influencing factors on the negotiation effect was established again,and based on this,a structure including 5 latent variables and 20 observation variables was constructed.Structural equation model,collect actual data through the design and release of survey scales,use AMOS22.0 to modify and optimize the structural equation model,and explain and analyze the action path.finally combine the relationship between the various influencing factors and the effect in terms of the degree of influence,the proprietor and contractor have proposed countermeasures to improve the effectiveness of project claim negotiation from three aspects: strengthening project management,using relationship governance and using negotiation skills.Through the research results,both parties to the project claim negotiation can clarify the different effects of the negotiators,business relationship,negotiation process and project environment on the effects of the claim negotiation,as well as the internal relationship of the15 detailed influencing factors,so as to be able to Before and during the claim process,we should further clarify our own rights and obligations,focus on communication and cooperation,and obtain a good claim negotiation effect,and improve the overall benefit of the project. |
