In the post-oil era,with the increasingly serious global environmental and energy problems,countries have turned their attention to the new energy vehicle industry,hoping to optimize the energy structure,ensure energy security and improve the environment through the promotion and use of new energy vehicles.China also strategically laid out the new energy automobile industry ahead of schedule,and introduced a large number of legal norms and subsidy policies in the early stage of industrial development,which enabled China’s new energy automobile industry to achieve leap-forward development in a short time,but at the same time,it also caused huge financial burden and large-scale fraudulent compensation.Therefore,our government decided to gradually reduce the scale and intensity of subsidies to the new energy automobile industry,and introduce the point system to replace the subsidy system,so as to improve and optimize the legal regulation and control mode of the new energy automobile industry.In September 2017,The Ministry of Industry and Information Technology formally proposed the new energy vehicle points system.However,there are some problems and shortcomings in the implementation process of the integral system,and it is necessary to further improve the integral system.The new energy vehicle points system is a system based on the points accounting system,with the new energy vehicle trading platform as the framework,and with the trading behavior of automobile enterprises and the main contents of their performance mechanism.There are three theoretical views on the legal nature of new energy vehicle points: the theory of property right,the theory of administrative regulation and the theory of new property right.New energy vehicle points should be regulated based on externality theory,Coase theorem and Pigou theory.The second part is Legislative status and existing problems of new energy vehicle points system.China’s new energy vehicle points system is mainly stipulated in the "Points Management Measures".Although the problems existing in the points trading of new energy vehicles have been corrected to a certain extent after several revisions,there is still room for further improvement and optimization in accounting standards,price regulation,supervision system,supporting system and so on.The third part is the perfection of the new energy vehicle points system in China.First of all,in improving the standard of integral accounting,we should strengthen the standard guidance of technological innovation,and pay more attention to the demand of low-carbon and environmental protection for the development of new energy vehicles when formulating standards;introduce the integral price control mechanism to control the integral price of new energy vehicles through the setting of "integral pool" and compulsory integral proportion,and guide the steady development of integral trading market;Thirdly,optimize the points supervision and management system,and improve the points supervision system by improving credit supervision and introducing multi-subject supervision;Finally,rationally plan relevant supporting systems to realize the road of automobile power. |
