Study On Illegal Fishing Control In Changshu Section Of The Yangtse River

The Yangtze River has abundant water resources and superior natural environment.As the mother river of the Chinese nation,it has enriched aquatic resources.In recent years,with the rapid economic development alongside Yangtze River Basin,the environmental conditions have also undergone tremendous changes and deterioration.And many species are already on the verge of extinction with aquatic resources declined sharply.At the same time,some people are driven by various factors such as economic interests,engaging in illegal fishing operations in the Yangtze River Basin,seriously affecting the sustainable development of aquatic resources in the Yangtze River.Since the 18 th National Congress of the Communist Party of China,the Party Central Committee and the State Council have attached great importance to the construction of the ecological civilization of the Yangtze River.President Xi Jinping put forward the general requirements for the promotion of the Yangtze River Economic Belt,"Joint efforts for great protection and no massive development".President Xi Jinping gave guidance for protecting the ecological environment of the Yangtze River.In recent years,relevant departments have made efforts to control illegal fishing in the Yangtze River.However,the problem of illegal fishing is still spreading.In the process of governance,there are difficulties such as imperfect coordination mechanisms and weak law enforcement forces which lead to ineffective governance.Therefore,it is worthwhile to further consider and study the proper management of illegal fishing and the protection of aquatic resources and ecological environment in the Yangtze River.This paper takes the illegal fishing in Changshu section of the Yangtze River as the research object.Through the use of literature analysis,investigation,case analysis and other methods,this paper discusses the current situation of illegal fishing in Changshu section of the Yangtze River and analyzes the causes,harms and current problems of illegal fishing.At the same time,it draws on the advanced management experience of illegal fishing in foreign countries,and puts forward countermeasures for the control of illegal fishing in Changshu section of the Yangtze River.The full paper is divided into six parts.The first chapter is the introduction,focusing on the background,significance and methods of this research,outlining the current research situation and research of illegal fishing at home and abroad.Through reading the literature and collating,I have a deeper understanding and understanding of illegal fishing.However,the research areas of illegal fishing by domestic and foreign scholars are mainly biased towards the ocean.The research on illegal fishing control in inland waters,especially the longest river in China is still lacking.The second chapter first analyzes the definition of illegal fishing,and discusses the definition of illegal fishing in China and abroad.It is concluded that the concept of illegal fishing is very complicated.At the same time,according to relevant laws,regulations and cases,illegal fishing in the Yangtze River are divided into four categories,namely fishing in contravention of the banned fishing periods,fishing in contravention of the fishing tools and methods,fishing without the fishing permit and fishing in contravention of the fishing permit.Meantime,the governance theory used in this paper is discussed.The third chapter takes the Changshu section of the Yangtze River to analyze the illegal fishing and the status quo of governance in the region.First of all,the fish resource in the Changshu section of the Yangtze River is introduced.Secondly,in order to further study the illegal fishing in the region,the paper analyzes the illegal fishing cases in Changshu section of the Yangtze River in the past three years(2016-2018)and studies the characteristics of illegal fishing cases in the region.The hazards of illegal fishing problems include damage to fishery resources and aquatic ecosystems,creating safety hazards and causing secondary crimes.At the same time,the reasons for the illegal fishing were analyzed.The reasons mainly included the difficulty of the local fishermen changing jobs,the economic interests,the weak legal awareness,the strong demand for aquatic products and the disorderly production and sales of fishing tools.Finally,the shortcomings of the current illegal fishing control in the region are sorted out.The existing shortcomings are that the multi-department linkage coordination mechanism is not yet established,the law enforcement power is weak,the law enforcement equipment is backward,the on-site disposal and evidence collection are difficult,etc.The fourth chapter analyzes and draws on the illegal fishing management abroad,mainly analyzing the international documents against IUU fishing and the fishery law enforcement experience in the United States and Japan.The law enforcement management system,law enforcement division,law enforcement equipment and law enforcement of the US fishery are advanced in the world.Japan’s fisheries law enforcement pays attention to the role of the fishermen’s group itself.In the process of fishery administrative law enforcement,administrative law enforcement is closely integrated with criminal justice.Administrative law enforcers can be given the jurisdiction of the judicial police and play an important role in promoting fishery law enforcement.The fifth chapter puts forward countermeasures for the illegal fishing control of Changshu section of the Yangtze River.The countermeasures are mainly based on the reasons of the frequent occurrence of illegal fishing and the lack of governance.The measures mainly include implementing the city’s withdrawal policy,strengthening the management of migrants and legal publicity,expanding social participation,fostering a healthy consumption concept and regulating the fishing tool market.In view of the shortcomings of current governance,the main measures include establishing a multi-department linkage and coordination mechanism,strengthening the construction of law enforcement teams,increasing investment in law enforcement equipment,enhancing the ability to dispose of evidence,further clarifying the prohibited fishing waters,improving the system of linking administrative and criminal laws,and implementing perennial law enforcement mechanism.The last chapter summarizes the research and also points out the innovation and shortcomings of this paper.
