A Study On The Legislative Protection Of Mongolian Medicine In Tongliao City,Inner Mongolia Autonomous Region

Mongolian medicine is an important part of traditional Chinese medicine and a valuable intangible cultural heritage in China.Mongolian medicine,with its unique concept of medical culture,not only makes an important contribution to the health and reproduction of the local people,but also injects creative vitality into the traditional medical culture of the world.Tongliao City in Inner Mongolia Autonomous Region is one of the birthplaces of Mongolian medicine in China and even in the world.It has a strong historical and cultural foundation of Mongolian medicine and rich resources of Mongolian medicinal materials.More than 50% of Mongolian medicine in China is produced in Tongliao City.Tongliao,as the capital of Mongolian medicine,should protect,inherit and develop the traditional culture of Mongolian medicine in the form of local legislation.In addition to the introduction,this paper is divided into four chapters.The first chapter is the analysis of the current situation of Mongolian Medicine Protection in Tongliao City,Inner Mongolia Autonomous Region.Although there are laws and regulations on the protection of Mongolian medicine at the national level and the autonomous region level,Tongliao City,as the "capital of Mongolian medicine",has not yet issued special legislation,and there are still unresolved problems in the cultural and environmental protection of Mongolian medicine.The second chapter is the legitimacy analysis of Mongolian Medicine Legislation in Tongliao City of Inner Mongolia Autonomous Region.Mongolian medicine is an important intangible cultural heritage in China.At the same time,the medicinal resources of Mongolian medicine are closely related to the protection of ecological environment.The legislative protection of Mongolian medicine is justified in both cultural and environmental protection.Tongliao City,through special local legislation to protect Mongolian medicine,has legitimate theoretical basis such as human rights theory,cultural diversity theory and biological diversity theory;legitimate legal basis such as constitution and legislative law;legitimate practical basis such as casting a strong sense of Chinese national community and protecting intangible cultural heritage.The third chapter is the experience of legislative protection of traditional medicine at home and abroad.Foreign countries have accumulated a lot of useful experience in the protection of traditional medicine resources,culture and medicinal materials,such as database system,special legislation and registration system.Similarly,China has accumulated more useful experience in the protection of traditional medicine,such as enacting local legislation,applying for the protection of authentic medicinal materials and so on.The advanced experience at home and abroad provides enlightenment and experience for the further protection of Mongolian medicine in Tongliao City.The fourth chapter is the Inner Mongolia Autonomous Region Tongliao City Mongolian medicine protection legislation proposal.Tongliao city should formulate "Tongliao Mongolian Medicine Protection Regulations" to protect Tongliao Mongolian medicine by local special legislation.The regulations should clarify the scope of intangible cultural heritage protection of Mongolian medicine in Tongliao City;establish the legislative principles of "inheritance and innovation,combination of protection and development","government led,public participation" and so on;stipulate the relevant systems of inheritor protection,medicinal materials protection,public interest litigation,Mongolian Medicine database,government support etc.
