| Inquisition refers to the system in which the Christian church uses its internal judicial power to try cases of heresy and witchcraft.Different from the secular judgment,this judgment mechanism seems to be only aimed at the church,but in the case of the integration of Christianity in all corners of European society in the middle ages,the influence of the inquisition was enough to cover the whole society.As an applicable mechanism for the judicial trial of the church,the inquisition plays an important role in suppressing heresy and maintaining the authority of the church.The first part of this paper firstly introduces the definition and content of heresy,and then analyzes why to judge heresy from the three perspectives of heresy,church and society,and explores the emergence of the inquisition.Secondly,this part sorts out the process of the establishment,development and decline of the inquisition.From the initial confusion to institutionalization,the inquisition procedure gradually formed a set of systematic standards,and the increase of legislative activities also provided a special basis for the inquisition,and the allocation of institutions and personnel was gradually improved.In the course of the history of the inquisition,the changes of the legal system such as the basis of the inquisition,the procedure of the trial and the evidence all show that the trial is developing towards a more rational and institutionalized direction.The second part mainly takes the representative of the Spanish inquisition as the representative,and specifically explores its establishment of goals,organization and judicial activities.The Spanish inquisition,which was established at a time when the inquisition was already flourishing throughout Europe,was able to apply directly the procedures and rules that had been systematized and to maximize their role.Different from other inquisition in other places,the inquisition in Spain was mainly set up for Jewish proselytes,and it was more under the control of secular power.These unique features are worth comparing and studying.The third part describes the operating mechanism of the inquisition systematically,including the scope of the trial and the trial procedure.The inquisition dealt mainly with cases of heresy,and also with a large number of witchcraft cases when witchcraft was prevalent in Europe.The inquisition procedure of the inquisition will be discussed from the aspects of subpoena,interrogation,judgment and punishment measures by comparing the relevantprocedures of Roman law,and will summarize the process from filing the case to making the judgment and executing the punishment.The last part of the article roughly analyzes the value of the inquisition in defense system,evidence system and litigation procedure and its contribution to the modern rule of law.At the same time,the twists and turns in the development process and the costs can not be ignored,I hope these can provide some reference and reflection for today’s development. |
