Rawls clearly points out that his theory of justice has four difficult problems and believes that the solution of three of them is not within the scope of his principles of justice,that is,it leaves three unresolved questions about " incompetence and disability","nationality" and "membership of the species".However,Nussbaum saw that Rawls’ theory of justice did not provide due guidance on the principles of justice for the above three problems,and examined to what extent Rawls’ theory of justice could be solved,so as to carry out the inheritance and transcendence of Rawls’ theory of justice.Nussbaum as Rawls ’s justice theory as the contract theory of the most powerful theory,she inherited the two justice principles of Rawls justice theory,principle of overlapping consensus of political liberalism,and the moral intuition behind rawls theory concept and moral emotion,on the basis of developed with dignity as the core concept of ability into the road.She analyzed Rawls’ three unresolved issues,pointed out the causes of the unresolved issues and the problems that would arise if they were not solved,and combined her capabilities to develop her own ideas on disability justice,global justice and non-human animal justice.In Nussbaum’s capability justice theory,the capability approach overcomes the deficiency of Rawls’ contract approach,and the capability-based justice theory solves the problems ignored or difficult to solve by Rawls in practice,it broadens the subject of social justice,provides a new perspective for the theory of justice,and promotes the development of contemporary ethics,so in a sense,her work of surpassing Rawls is successful.However,his theory still has two limitations: the over-reliance on intuitionism and the ambiguity of the capability approach itself.
