Study On Legal Protection Of Rural Women’s Land Rights And Interests

In China’s rural areas,the land is the basic problem of the majority of agricultural population to solve the basic problem of food and clothing,to achieve the survival and development of the foundation.Land rights and interests is also the most important property rights and interests of farmers,protection of farmers’ land rights and interests is a major issue related to the overall economic and social development,urban and rural coordinated development.Influenced by the traditional concept and personal qualities,the rural women are more dependent on land than men,so it is more important to protect the rights and interests of rural women’s land.Although the provisions of state laws and regulations of the basic principle of equal protection of land rights and interests of both men and women,also made the relevant provisions of the protection of land rights of rural women,but gender equality in the practice of the land system has not been effectively implemented.Based on the reality of current land rights of rural women,with the court case relates to the land rights of rural women,explore the causes of rural women’s land rights and interests damage,as well as the difficulties in the judicial practice in the trial of such cases in the trial,focusing on conflict resolution.The author thinks that the protection of rural women’s land rights and interests,should do the following: 1,accelerate the reform of collective land property rights system;2,in accordance with the "by copies of stock cooperation" principle of collective land property improvement;3,improve the proportion of rural women’s political participation;4,the abolition of illegal pacts;5,improve the judicial remedies,improve the relief mechanism.
