Study On The Maritime Management System Under The Rule Of Law

Maritime management system under the rule of law,is a part of administrative government by law construction,it helps the standardization of the administrative power operation,help to achieve the goals of administrative,contribute to the country’s modernization construction.Maritime management system of government by law construction is to promote maritime is an important content of modern management system and management ability,is the inherent requirement of specification and the safeguard maritime administrative power to work effectively.To realize the rule of law in the maritime management system,it is necessary to meet the strategic requirements of comprehensively deepening the reform and comprehensively governing the country by law,to meet the requirements of the goal of building China into a strong transport and maritime power,and to better serve the development of China’s maritime undertakings and economic and social construction.This paper makes an innovative analysis of the legalization construction of maritime administration system,takes the promotion of the standardized and efficient operation of maritime administration power as the entry point,analyzes the legal guarantee system it should have,and then deduces the system mechanism it should have,and defines the content of reform in the existing system.At present,China’s maritime management system is a four-level dual-track management system,but there are problems of insufficient legalization in the aspects of organizational law,behavioral law and supervision law.The system is the carrier of the rule of law,and the rule of law is the operation result of the system.To realize the legalization of maritime administration system,it is necessary to realize the legalization of maritime administration power.This article from the ocean of maritime administrative power and administrative attribute two aspects,the nature of the maritime administrative power is analyzed,based on the requirement of the maritime administrative power configuration is proposed under the rule of law,still from the organic law,law,surveillance law through the analysis of the three angles,proposed to cover administrative power operation process of maritime administrative law system and matching maritime management system.Maritime management system under the rule of law reform path is through laws,regulations,further clarify the source of the maritime administrative power,the issues involved,the scope and procedures,real let maritime administrative power comes from,according to the method,system method,to the maritime administrative power,the whole process from production to play a role in the specification of the maritime administrative law,which requires to build perfect maritime administrative law system,and on this basis to build institutional setup,staffing,distribution of power and responsibility as well as coordination and collaboration between institutions as the core of the maritime administrative power operation guarantee mechanism,realize the maritime management system under the rule of law.Combined with the actual situation of maritime management system,this paper respectively expounds by making a special law to promote the construction of maritime laws and regulations system,to perfect the existing legal system to promote the path of the maritime legal system construction,combined with the current maritime institutions "four-stage double-track" management system is put forward to promote maritime management system under the rule of law construction reform path.
