An Analysis On The Construction Of Natural Person Bankruptcy System

The bankruptcy system of natural person is a common bankruptcy system in the world,which is the product of the development of commodity exchange under the market economy.Whether it is common law countries or civil law countries,or whether it is bankrupt businessmen or generally bankrupt countries,The bankruptcy system of natural person has always occupied an important position in the bankruptcy law.It has been more than ten years since the implementation of the enterprise bankruptcy law in China,but regrettably,the bankruptcy of natural person is still excluded from the bankruptcy system in China.With the further development of China’s market economy,China already has the realistic foundation of establishing the bankruptcy system of natural person.This paper first reviews the history of natural person bankruptcy system,defines the concept of natural person bankruptcy,then analyzes the necessity and feasibility of establishing natural person bankruptcy system in China,and finally discusses the concrete construction of natural person bankruptcy system in China.The first chapter firstly summarizes the evolution of natural person’s bankruptcy system,mainly expounds the definition of natural person’s bankruptcy and the value contained in natural person’s bankruptcy system.The second chapter mainly analyzes the necessity and feasibility of establishing the bankruptcy system for natural persons in China,including the necessity of thoroughly resolving the debt crisis and the need to integrate with the international community,and the feasibility is mainly discussed from three aspects: economic environment,cultural environment and institutional environment.The third chapter mainly introduces and analyzes the bankruptcy system of natural person in Hong Kong and Taiwan,common law countries and civil law countries,and finds out the experience and lessons of reference significance for China.The fourth chapter mainly combines China’s national conditions and puts forward Suggestions on how to construct the specific system of natural person bankruptcy,which mainly involves the legislative mode of natural person bankruptcy system,the construction of natural person bankruptcy system procedure and the construction of natural person bankruptcy system entity.
