On Comparative Study Of Enterprise Registration System Between Laos And China

Laos and China are both developed from planned economy to market economy.There are many similarities and differences in the reform of enterprise registration system.The purpose of the comparative study on the enterprise registration system of Laos and China is to find out the problems existing in the enterprise registration system of Laos and the experience in the reform of the enterprise registration system of China,and to put forward valuable suggesti ons for reference to the enterprise registration system of Laos.Based on the analysis of the legislative origin,legislative form,legislative style,classification of enterprise registration,nature of enterprise registration,similarities and differences of enterprise registration contents and other legislative status of enterprise registration in China and Laos,this paper puts forward the enlightenment and reference of Chinese enterprise registration legislation to Laos.The enlightenment includes: we should constantly improve the enterprise registration legislation in Laos;strengthen the management of enterprise registration law enforcement;make the disclosure of registration information more open;increase the legislative content of enterprise credi t constraint and incentive.The reference for Laos’ enterprise registration includes: making special enterprise registration law;strengthening the legislation of administrative litigation;making the registration information open through the network;maki ng the legislation of enterprise credit restriction and incentive.Through the analysis of the similarities and differences between Laos and China’s enterprise registration system models,such as the legislative form model,legislative content model,legislative review and supervision model,this paper puts forward the enlightenment and reference of China’s enterprise registration system model to Laos.The enlightenment to Laos enterprise registration system includes: the establishment of Chinese enterprise registration system model is obtained through continuous reform.China’s legislation on enterprise registration has become more flexible.The reference for Laos is: Laos should set up the concept of reform,and constantly reform the enterprise registratio n system,so as to meet the needs of market economy development.We should adopt more flexible legal policies on the content of enterprise registration legislation.Based on the comparative analysis of the roles of enterprises registration government in Laos and China,this paper puts forward the enlightenment and reference of Chinese enterprises registration authority and jurisdiction to Laos.The enlightenment to Laos is that the responsibilities and powers of the enterprise registration management department should be unified.While relaxing the conditions of enterprise registration,the government authorities can not lower the management standards.We should attach importance to the transformation of government function from management type to service type in enterprise registration.The reference for Laos is to clarify the responsibilities and powers of the enterprise registration management department.At the same time of reducing the conditions of registration,we should establish more post supervision legal system.Provide more services for enterprises.Through the comparative analysis of the ways and contents of the enterprise registration review procedures in Laos and China,this paper puts forward the enlightenment and reference of Chinese enterpris e registration to Laos.The enlightenment to Laos is that: Chinese enterprise review mode pursues formal review more;Chinese enterprise registration review procedure is more specific than Laos;Chinese registration mode is more flexible.The reference for Laos is: to perfect the special legislation of enterprise registration and review;to refine the steps of registration procedure;to increase the contents of enterprise registration announcement and publicity.
