Research On Criminal Law Regulation Of Environmental Crime Of China

Since the 20 th century,frequent environmental problems have gradually attracted worldwide attention.More and more environmental issues such as global warming,melting of Antarctic glaciers,voids in the ozone layer,and water shortages have already occurred.In recent years,major disasters such as thinning Arctic sea ice,landslides in Indonesia,the Amazon fire,and Australian mountain fires have occurred.The reasons for these disasters are often humans’ excessive demands from the environment and excessive pursuit of interests.Faced with these major environmental issues,countries around the world have gradually strengthened their criminal law regulations on environmental crimes,regulating behaviors that seriously endanger the environment and cause significant losses,or place the environment in a state of major danger as environmental crimes,and to prevent and curb human damage to the environment by punishing sanctions.China has also gradually strengthened its crackdown on criminal acts that endanger the environment.The paper starts with the basic theoretical overview of environmental crime in China,analyzes our concept and characteristics of environmental crime,and conducts a review of environmental crime in China.Then,I analyze the criminal regulations of environmental crimes in some representative countries,such as Germany,Japan,Britain,and the United States,and I compare and analyze the three points for environmental crimes in China,such as criminal law cracks down on crimes,expands the application of property penalties,and adds environmentally dangerous criminals.For these four countries entered the industrialized society earlier,they started to pass criminal regulations to regulate environmental crimes earlier,and have achieved great results.Although the regulation of environmental crimes in these countries is in line with their national conditions,and China has different cultural backgrounds and legal soils,it can’t be copied without identification.It is necessary to make practical and appropriate national conditions based on reference change.The third chapter analyzes the shortcomings of China’s criminal regulations on environmental crime,and puts forward perfect suggestions in the fourth chapter.The difficulty of this thesis lies in how to improve the environmental crimes in China,and how to make changes in accordance with China’s conditions in other aspects that can be used abroad to obtain good results.In the academic world,there have been many papers discussing this topic.In contrast,this paper mainly finds out the urgent problems in environmental crime in our country from the practical perspective,and puts forward constructive opinions.
