| Since the birth of human navigation,human factors such as military wars and armed conflicts have been plaguing navigation safety.The hegemony of maritime power among countries has seriously affected the development of the maritime industry,and these factors have constituted traditional maritime security threats.In the 21 st century,the theme of the era of peace and development makes war no longer the main threat to shipping safety at this stage.Instead,it is replaced by a series of maritime non-traditional security issues such as piracy,maritime terrorism,and marine environmental pollution.my country is steadily advancing the“Belt and Road” initiative and the “Ocean Power” strategic plan.The implementation of these strategic objectives must be based on shipping safety.However,the increasingly rampant piracy crimes in recent years have seriously affected my country’s maritime security and caused a significant impact on my country’s maritime "Belt and Road" transportation trade.As early as 2008,my country sent a naval formation to the Somali waters to escort,which played a good role model for the international community to cooperate in combating piracy.However,in2009,the Shandong oil tanker Dexin was hijacked by pirates in the Gulf of Aden,which made the Chinese public resentful of the problem of piracy and caused heated discussions.Because of their obvious transnationality,mobility,and diversity,pirates are raging around theworld,which has caused a big impact on the safety of international shipping and hindered the stable development of world trade.Some parts of Asia are located in international shipping.The main roads of sea traffic are subject to pirate crimes and armed robbery attacks,so there is an urgent need for targeted legal regulation of pirate crimes.In this context,it is also possible to use legal means to combat piracy crimes to achieve strategic goals.From the perspective of marine non-traditional security,this article specifically analyzes the troubled piracy crimes of various countries,and uses dual perspectives of international law and domestic law to analyze the problem,with a view to regulating piracy crimes with laws and policies,thus laying a theory for responding to non-traditional marine security threat basis.This paper is divided into four chapters.The first chapter mainly discusses the characteristics of traditional and non-traditional maritime security and their similarities and differences from the perspective of concepts.The second chapter mainly discusses some international measures to combat maritime crimes from the perspective of non-traditional maritime security and their loopholes.The third chapter describes how domestic law and international law guide and learn from each other in combating maritime crimes by using a new perspective--the double coordination and regulation of international law and domestic law.The fourth chapter is based on the analysis of the first three chapters to find appropriate legal countermeasures for China to deal with maritime crimes in the future under the non-traditional maritime security. |
