"Limit" Or "No Limit"

With the development of China’s social economy,the highway network is extending in all directions,the number of cars is increasing year by year.At the same time,the road traffic situation in China is becoming increasingly severe.The speed limit of road traffic was designed to maintain traffic order and ensure the safety of drivers’ lives and property,but now,more and more people are suffering from overspeed punishment caused by road speed limits being too low or speed limit changes frequently,which leads to speeding penalties.The low speed limit not only causes traffic congestion,but also a serious waste of road resources.Therefore,there are more and more calls for canceling domestic speed limits or increase of the speed limit.Many scholars also calculate road limits from the perspective of road engineering through data speed.However,the existence or abolition of the speed limit system or the determination of the speed limit is by no means simply a matter of simple technical engineering.Our country has a long history of speed limit systems and has played a huge role in maintaining the stability of traffic order.In China’s current social background,the speed limit system still has its value.In fact,the reason why so many problems with road traffic speed limits cause so much doubt is not because the speed limit is high or low,but because of problems in road speed management.Therefore,the solution of the speed limit problem cannot rely solely on engineering theory and technical means,it must start with the system itself and fundamentally solve the shortcomings of the current speed limit system by regulating the speed limit management.This article starts with the management of the speed limit system.By sorting out the evolution of China’s road traffic and speed limit system,combining the foreign and domestic social and cultural backgrounds,and analyzing the necessity of the current speed limit system from the perspective of law and economics.Based on the empirical analysis of the problems in China’s road traffic speed limit management,the chaos of speed limit management has caused low traffic efficiency and an increase in administrative disputes,which is contrary to the original intention of legislation.Finally,the reasons behind this improper speed limit management are analyzed through the theory of law and economics,mainly through cost-benefit analysis,and the role analysis of the "rational person" of the administrative agency."Economy" gains benefits,and analyzes the rent-seeking and phenomena in the administrative management process.Based on this,a simple countermeasure to regulate this phenomenon is to restrict the arbitrariness of administrative power through standardized procedures in order to protect citizens’ rights and interests.Restore the normal order of road traffic.
