Research On Protection Of Rights And Interests Of Land-lost Farmers In Transformation Of Urban Villages

During the process of urbanization,China has begun to transform the villages in the city vigorously.Through the transformation of villages in the city,Land-lost farmers will live in buildings,and their life style will change dramatically.Their way of life will be close to urban residents’ gradually,but there are still problems and deficiencies in many aspects.If these problems and deficiencies are not solved,land-lost farmers will become an obstacle to the harmonious development of society.How to properly protect the rights and interests of land-lost farmers has become a problem that cannot be ignored during the economic and social development process in our country.Based on the comprehensive research status at home and abroad,this thesis summarizes the practical exploration experience of the transformation of villages in different cities in China,takes the transformation of Weijia,Zaolin and Xiaotun three urban villages as the background,which are involved in the national level green intelligent manufacturing town construction project in Dangjia sub district office of Shizhong District of Jinan City.By using the methods of literature analysis,induction deduction,comparative analysis the following research work has been carried out: Firstly,this thesis studies the related concepts and basic theories of the protection of the rights and interests of the land-lost farmers in the urban village transformation,and analyzes the internal logical relationship between the urban village transformation and the rights and interests protection of the land-lost farmers.Secondly,this thesis investigates the basic situation of the above three villages in the city,as well as the land compensation,villagers’ employment,children’s education and other support conditions.It is found that there are still problems and deficiencies such as unreasonable land acquisition,irregular land acquisition procedures,difficult employment of land-lost farmers,and short board of children’s education.The specific reasons are deeply analyzed.Finally,according to the current situation of the reconstruction of Weijia,Zaolin and Xiaotun,the corresponding countermeasures are put forward.There are main four aspects:Firstly,improve the land compensation mechanism.One is to define clearly the scope of public interests of land acquisition;The other is to improve the distribution system of value-added income,consider the enlarging influence of urban village location to raise the compensation standard of land acquisition on the unified standard of Jinan City.Secondly,improve the implementation mechanism and supervision and inspection mechanism.This thesis proposes the following suggestions: Firstly,to further define the power and responsibility of the project construction headquarters,to compact the main body of responsibility,to highlight the key points of supervision and improve the supervision mechanism;Secondly,to respect the interests of the majority of the village collective,to prevent the phenomenon of "free riding" and protect the interests of the minority;Thirdly,to broaden the information channels and expression mechanism of the village people.Thirdly,improve the employment security system.On the one hand,land-lost farmers can combine their own advantages,internal interests,personal needs and so on to seek jobs in the new opportunities.On the other hand,the government guides land-lost farmers to make their own career plans and seize the opportunity to realize employment transformation or industrial upgrading.Secondly,the government needs to provide basic skills training for land-lost farmers,including law,culture,safety and so on.The sub district office should cooperate with the civil affairs department and the human resources and social sectors to guide all-round progress of land-lost farmers and give full play to the leading position of the government in employment training.Thirdly,the government and social organizations can expand the employment channels of land-lost farmers from information consultation,labor intermediary recommendation,community absorption,enterprise placement,characteristic town construction,labor export and other aspects.Fourthly,improve the education guarantee mechanism for children.The education of children in the process of urban village reconstruction should be considered in an all-round way,not only relying on school education or family education alone.The government should give full play to the leading role,the school should give full play to the main position role,the family should give full play to the basic role.The three should play their own functions,but also cooperate with each other to solve the education problem together,especially the education of children’s values.
