On The Inference Of Investigation And Its Thinking Mode

As an important theory to guide investigative practice,investigative logic is constantly being improved.With the frequent use of investigative inference methods in criminal investigation,the research on the independence of investigative inference is imminent.Only by systematically researching the concept,thinking form and operation mode of investigative inference can we continuously improve the theoretical system of investigative logic and better guide investigative practice.This article states in the introduction that investigative inference as a logical method has been widely accepted in criminal investigations.Through literature review,it introduces three current ideas for investigating investigative inference.It is clear that research on investigative inference is both an investigative logic.The supplement of the theoretical system is also an urgent need for investigative practical work.In view of this,this article begins the discussion in the following five sections.This paper is divided into five parts:The first part: Investigation inference and its necessity and possibility.By introducing inference and its application in the field of forensic science and criminal investigation,the concept of investigation inference is derived,that is,the reasoning made by the investigating staff based on known conditions(case facts or general laws,theorems,knowledge and experience,etc.)Derivation and conclusion.Investigation inference is both a dynamic process derivation and a static result judgment.It then analyzes the differences between investigation inference and investigation inference,presumption,and inference,and clarifies the different uses of different investigation methods.The necessity of investigative inference lies in the complexity of causality in criminal cases,and the possibility lies in the fact that the probabilistic and retrospective characteristics of investigative inference coincide with the specific content of investigative practice.Clarify the research status of investigation and inference,and find the research direction of this article from the shortcomings.The second part: Specific methods of detection inference.Focusing on theanalysis of the thinking methods used in the dynamic derivation of investigative inference,including both investigative inferential methods based on logical thinking and investigative inferential methods based on non-logical thinking,the concepts of various investigative inferential methods are clarified,and the derivation forms are exemplified.It also points out the precautions in the application of various investigation and inference methods.The third part: Inference mode in the mode of investigation thinking.As the thinking system of a system,the mode of investigation thinking not only indicates the logical procedure that the investigation shows,but also indicates the investigative thinking contained in the logical procedure.Try to construct the thinking mode of investigation inference,and explain the operation mechanism of the thinking mode,so as to clarify the specific role of investigation inference method in the investigation thinking mode.The fourth part: The concrete application of the method of investigation inference in the investigation practice.Apply the relevant theories of the first,second and third parts to the investigation practice,through the adaptation of a criminal investigation case,understand the specific application process of the investigation inference method in the example,emphasize the importance of using the investigation inference method.The fifth Part: Conclusion.Investigation inference is still a logical thinking method in essence.It is of great significance to expand the understanding of the case and expand the direction of investigation,and it should have a place in the logical thinking system of investigation.
