As an important driving force of the fourth industrial revolution of mankind,big data technology is characterized by its mass storage capacity and second-level processing speed.Its application has brought great impact on social life and work,especially its combination with the Internet 3.0 era,which has also influenced and reconstructed the traditional way of thinking.In the era of decentralized communication,we will deeply explore the impact of the change of information transmission mode on legal communication with the support of data technology,which provides technical and theoretical support for the change of legal communication mode.At present,there is no research on law transmission with the perspective of big data.Building a law-based governance country requires the society to operate in the framework of law,which is also the inner meaning of the rule of law.As the highest standard of society,law is closely related to social life.Under the background of technological change in the era of big data,we can analyze the new opportunities for legal communication in the era of big data with the help of communication theory,and explore the functions of legal communication in the era of big data,so as to contribute to the construction of lawbased governance.In addition to the introduction and conclusion,the thesis consists of three parts:The first part explores the basic category of big data and legal communication.About big data,by introducing the meaning of big data and the characteristics of big data in detail,big data is defined as three similar terms:the large data scale,the insufficiency of existing technology and the data set.Meanwhile,the characteristics of big data are summarized as "4V".Regarding legal communication,according to the theoretical division of communication,legal communication is divided into five structural elements: communicator,audience,information,media and feedback.This part summarizes the three types of existing legal communicators and explores the types of audience from the perspective of the content of legal acceptance and explore the difference between legal information and general information with the perspective of content,process,source and form of expression,briefly analyzing the media of legal communication,analyzing the feedback mechanism of legal communication from the perspective of communication science and attributing the feedback mechanism to the legal interaction between the communicator and the audience.The second part explores new opportunities for legal communication in the era of big data from four perspectives: the transformation of the main body of legal communication,communication content and media,citizen participation in law implementation and communication thinking.From the perspective of both of the communicator and the audience,the subject of communication has the features of transformation and hybrid,that is,the communicator and the audience transform from one to the other,and the government and civil organizations become the organizational type of audience.From the perspective of communication content and media,legal information has the characteristics of digitalization,that is,the convenience of consulting static electronic legal norms and the supervision of synchronous recording of dynamic law implementation behavior.The media has the electronic characteristics,that is,the Internet is used as the media to build the Intelligent Court.From the perspective of law implementation,the law implementation under the citizen’s participation is faced with new opportunities,That is,at the legislative level,citizens participate in the enactment of the Civil Code;at the level of law implementation,citizens’ feedback on the entrapment;at the judicial level,citizens’ opinions on the effect of specific cases are expressed,and at the level of public supervision,the public supervises the fight against the COVID19.From the perspective of communication thinking,the full data thinking focuses on the individual needs of the public;hybrid thinking focuses on the expression of individual rights;relevance thinking integrates government information.The third part responds to the new opportunities of law communication and explores how to use big data technology to optimize the function of law communication.This part will study new developments in legal communication from the perspective of technology,system and thought with the development of communication paradigm "knowledge gap hypothesis" and supplemented by specific cases and three ways of thinking transformation in the era of big data.At the technical level,from the perspective of full data and the perspective of social structure to individual needs,this paper analyzes the inevitability of accurate legal communication,pays attention to the individual needs of the public,and responds to the opportunities of big data for electronic communication media,and enhances the understanding and trust of the public on the legal communication process.At the institutional level,from the perspective of relevance,this paper takes the construction of government information platform as an example to analyze the trend of government information integration and respond to the opportunities of big data for participating in the subject relationship and law implementation,to disseminate scientific administrative behavior and build a service-oriented government and promote the modernization of government governance capacity and governance system.At the ideological level,from the perspective of hybridity,the author takes the data rights as the breakthrough,from data sense to data consciousness,to provide theoretical support for the cultivation of the consciousness of rights and to realize the process from the consciousness of rules to the concept of fairness and justice to the consciousness of rights within the framework of the structure of legal consciousness.In a word,this thesis will focus on the exploration of the four new opportunities for legal communication with the problem of audience passivity and official dominance of original law communication and lack of communication feedback oriented.At the same time,from the perspective of technology,system and ideology,it studies the optimization of big data on legal communication and responds to the above opportunities,that is,the precise dissemination of laws,the dissemination of scientific administrative behavior,the cultivation of the consciousness of right,the search for theoretical support for the legal communication in the era of big data,and the theoretical guidance for the later practice of legal communication.
