At present,China is vigorously developing the socialist rule of law and promoting the rule of law.In the stage of the government’s transformation from management function to service function,the new administrative means gradually appear and play an important role in the government’s management.The administrative interview system is the new administrative hand.Different from previous administrative ACTS,administrative interview has its unique function and value.This not only effectively reduces the loss of the communication between administrative mechanism and person subject to administration,but also plays an significant role in improving the administrative organ’s flexible governance ability.For the administrative interview system,the governments of all parts of our country have made policies related to it,but the academic circle has not paid enough attention to it,the research content is not thorough enough,not comprehensive enough,and on the key issues of administrative interview theory and practice have different views.At present,the administrative appointment,applied to food and drugs,taxation,environmental protection and other fields,but,in all areas of the execution of administrative function of questioning and the development direction of the desired,especially administrative appointment system and the traditional administrative concept confusion,confusion of the distinction between them and the line,will eventually cause administrative appointment,the realization of the function and purpose can not be reasonable and effective.This paper firstly collects,reads and sorts out a large number of relevant literature through literature research method,and queries the literature related to administrative interview with the knowledge network,so as to have a comprehensive understanding of the administrative interview system in China,and then more clearly define the content of the administrative interview system.Through understanding the theoretical basis of administrative interview,we know that administrative interview is a non-compulsory administrative means.This paper analyzes the functional value of administrative interview with functional analysis method,and understands the purpose and function of administrative interview to solve the problems encountered by administrative subjects.Secondly,in the knowledge of the legal attribute of administrative appointment,deeply analyze the existing problems in the administrative questioning,mainly caused by the lack of legal norms,the legal nature of administrative appointment system chaos,questioning cause unclear orientation of the mandatory words of questioning has been increasing,the initiator’s smart casual leads to the excessive use of questioning,the rule of law in our country foundation weak lead to alienation of questioning is outstanding,a series of problems in the administrative questioning also show that the system run severely hinder the rule by law.Finally,some suggestions are put forward for a series of problems in the operation of administrative interview.For example,we should improve legislation,standardize implementation procedures,strengthen supervision and improve relief mechanisms.The rule of law is not only conducive to its standardization in various fields,but also plays an important role in the construction of democracy and governed by law in China.
