Research On Administrative Interview

With the diversification of economic and social interests in China,administrative interview is a new type of administrative behavior characterized by flexible law enforcement.As a regulation tool widely used in various fields of administration,administrative interview represents the transformation from mandatory law enforcement to flexible law enforcement.It is widely used in the practice of administrative law enforcement and plays an increasingly obvious and important role.However,at the beginning of the development of administrative interview,there are many defects and problems in the legal system of administrative interview,which need to be improved and solved.To solve the problems of low level of basis,disorganized content,lack of stipulation of principle of interview and inconsistent content in most cases,we should improve the main content of legislative level and unified basis of administrative interview,and add and unify the stipulation of principle.In view of the problem that the subject of administrative interview is not clear and the object is too strict,the subject of interview should be clarified and the object of interview should be relaxed.In view of the confusion of the scope of application of administrative interview and non-standard procedures,the scope of application of interview should be unified,the initiation and implementation procedures of interview should be improved,and the connection with other procedures should be strengthened.In view of the lack of supervision and relief in the administrative interview,we should strengthen the supervision of the interview,bring the interview into the scope of accepting cases of administrative reconsideration and administrative litigation,and implement the responsibility of administrative compensation.Through the in-depth study of administrative interview,it is beneficial to build a systematic and perfect system of administrative interview,standardize the operation of administrative interview,and then give full play to the functions and effects of administrative interview.
