A Comparative Study Of Police Rights

The police system is related to the national security and social stability.Improving the police system is the basic needs of ever y country and people.As the core of the system,the study of police power has important theoretical significance and application value.Through the discussion of the conflict and balance of police power and rights and interests,it has important theoretic al and practical value for the improvement of relevant systems in China.The study of police power in China has gone through the process from scattered to specialized,from affiliated to independent.The comparative study of police rights and interests sta rted relatively late,and much of the research was focused on the setting and attributes of police power.However,the research on the refinement of police power and the protection of police rights is insufficient in both breadth and depth,especially for the police as an ordinary citizen The research on the right and protection of police is very limited in the special professional context of police,which is not conducive to the smooth development of police law enforcement to a certain extent,and is not c onducive to the sound development of China’s police cause objectively.On the basis of comparing the system measures of other countries in dealing with this conflict,and on the premise of conforming to the actual situation of China,using the good system of other countries for reference,in order to further improve the police system of our country,realize the balance between the restriction of police power and the protection of rights and interests,construct the police system in line with the internation al standards,and put forward suggestions and ideas to improve the relevant system of our country.Based on the statistical data and some cases happened in recent years,the author consulted some domestic and foreign related research literature,and studie d the current police system in various countries and regions.Through the investigation of the origin of police,police power and police rights and interests,this paper discusses the differences between China’s police rights and interests protection syste m and other countries’ police rights and interests protection system from the aspects of legislation,police law enforcement protection,education and training protection,welfare treatment protection and practical issues.It also looks for the gap between China’s police security system and other countries.This paper puts forward the balance and coordination method of police power and police rights and interests: first,it analyzes the revised draft of the new police law and points out its progress and lim itations.Secondly,it discusses the suggestions of the police law in the field of legislation: adding the crime of attacking the police;establishing the police duty defense right;improving the police professional security system;strengthening the polic e vocational training;optimizing the police casualty pension system.
