Research On The Protection Of Police And Citizen's Rights And Interests Under The Background Of Comprehensively Implement The Rule Of Law

Public security organs are an important part of state power and play an important role in state governance.In addition to exercising the criminal justice function,public security organs also exercise public security administrative functions.the daily work of public security police is closely related to citizens in the maintenance of public order.There will also be conflicts between the police and the citizens,which will seriously infringe on the rights of both parties,because of work reasons.The rights protection measures in the conflict between the police and the citizens are still not perfect,which is contrary to the current spirit of the rule of law.Comprehensive rule of law is the essential requirement and important guarantee of socialism with Chinese characteristics.General Secretary Xi has proposed a series of new ideas,new thoughts and new strategies around the comprehensive rule of law since the 18 th National Congress of the Communist Party of China,which provides a basis and direction for us to improve the security measures for the police and the people from the perspective of the rule of law.The rule of law is an important support for the State Governance Capability and Modernization of Governance System.Perfecting the police and the citizens' rights and interests guarantee system at the level of the rule of law must also adapt to the changes of the times.Helping to build a socialist rule of law system with Chinese characteristics,the building of a harmonious society,comprehensive construction of a well-off society and the construction of a strong socialist country.This paper uses the literature analysis method and the case study method to analyze the protection of the rights and interests of the police and the people from the perspective of the rule of law.Taking the current police-civilian relationship as the starting point to lead to the phenomenon of local police-civilian conflicts,and then discussing the violation of police and citizen rights in the conflict.This article is divided into six chapters.The first chapter is the introduction.The second chapter is the definition of the core concept.The third chapter is the status quo of the police-civilian relationship.The fourth chapter is the violation of rights and interests in the conflict between the police and the people.The fifth chapter is the boundary of the protection of the rights and interests of the police and the people.It is a comprehensive rule of law to promote the protection of the rights and interests of the police.The first two chapters lay the foundation for the main analysis of the article.The last four chapters are based on the progressive structure of the text.The key to the protection of the rights and interests of the police and the people is the boundary issue.It is concluded that the spirit of governing the country should be carried out in an all-round way.The main problem of the current police and citizens rights protection is that the border between the police and the citizens is unclear.In some cases,the protection is insufficient or the protection is excessive,resulting in violation of the rights and interests of the police and the people.This paper analyzes the border issue of police conflicts or administrative management,and puts forward suggestions for improvement from the perspectives of legislation,law enforcement,justice,and law-abiding from the perspective of insufficient protection of rights and interests in current police conflicts.
