Abstract/Summary:
In the era of the rapid development of the Internet and big data,e-commerce is also moving forward with an increasing momentum.Consumers are paying more and more attention to the security of personal information in the process of electronic transactions.While e-commerce brings convenience to life,it also brings some problems.Consumers’ personal information leaks have emerged endlessly,Consumers’ privacy and security is affected seriously.It requires China to speed up the formulation and improvement of laws and regulations related to issues of personal information security in e-commerce.Protecting against of criminals.On January 1,2019,the Electronic Commerce Law officially came into effect.Following the Cyber Security Law,the law once again reaffirmed the protection of personal information.However,as the first comprehensive law in the field of e-commerce,the“E-commerce Law” has limited provisions on the protection of personal information in e-commerce,and can’t regulate the continuous invasion of consumer personal information in real life.Therefore,the improvement and improvement of relevant laws and regulations related to the protection of consumer personal information related to e-commerce are urgent.Studying the legal systems related to consumer personal information protection in e-commerce is of great significance for protecting consumer rights and promoting the development of the e-commerce industry.From the perspective of e-commerce personal information security,this paper studies the consumer personal information protection system by means of case analysis and comparative analysis.The article contains the following five parts.The first part introduces the definition of consumer personal information protection and e-commerce.This paper expounds the terms of consumer personal information and e-commerce,and analyzes the characteristics of e-commerce.The second part introduces the legislation and security of consumers’ personal information in e-commerce in China.Firstly,this paper analyzes the main infringers of consumers’ personal information in the field of e-commerce and the main forms ofinfringement of consumers’ personal information,then lists the laws on the protection of personal information in China,and then analyzes the defects of the personal information protection law in China.The third part introduces the experience of personal information protection law of electronic commerce in the world.Mainly to the United States,the European Union and Japan legislation in detail,comparison and analysis of the United States,the European Union and Japan about personal information protection laws and regulations and to Japan,the European Union,the United States in the electronic commerce consumers personal information protection industry autonomy,summarizes the legislative situation analysis,and relevant lessons.The fourth part summarizes the experience of personal information protection of e-commerce consumers and puts forward relevant opinions.In the whole article,the emphasis is on the content of the fourth part.Based on the basic national conditions of China,this paper studies the lessons of Europe,the United States and other countries,and puts forward the Suggestions for the optimization of legislation,industry self-discipline and consumer awareness.
