Study On The Protection Of Laborers’ Rights And Interests In Labor Dispatching In China

The reform of labor market is an important reflection of the overall reform of China’s socialist market economy.The labor dispatch system has been widely developed and rapidly promoted in China.Its flexible management form and high adaptability to the industrial structure make the labor dispatch system play an irreplaceable role in reducing the pressure of employers.With the employment situation becoming more and more flexible and the labor market becoming more and more unembedded,there are inevitably a series of problems in the process of the development and perfection of labor dispatch system.How to promote the normative development and effective unification of labor dispatch system has become an important issue in the field of human resources and social security related research as well as in the field of jurisprudence related research.Based on this,this paper studies the protection of the rights and interests of laborers in labor dispatching,using literature research,comparative analysis and induction and deduction method research methods,such as access to the staffing mechanism and main body status of qualified,sending the basic terms and conditions stipulated in the contract,send in the duties of unit of choose and employ persons and so on carries on the summary,and sums up the current protection of the rights and interests of laborers in labor dispatching,summarized the difficulties.It is difficult to guarantee equal pay for equal work and equal rights;it is difficult to realize the social security rights and interests of laborers dispatched;it is difficult to realize the labor dispute relief;legal protection for laborers is limited;and the neglect of the rights and interests of dispatched laborers by dispatching units and labor units restricts the protection of the rights and interests of dispatched laborers in China.In the legislation and law enforcement level,strengthen the protection of the rights and interests of dispatched workers social security,expand the system of labor dispute in the judicial relief way,improve the dispatched workers legal rights and interests protection and improve the dispatching agency management regulation,perfected for dispatching laborers rights protection mechanism.
