| In recent years,China’s sharing economy has developed by leaps and bounds,and its speed of upgrading and creating new jobs has attracted global attention.Sharing economy is increasingly influencing us,from food,clothing,housing and banking to finance,which are bringing new growth points and new development opportunities to China’s economic take-off.Relying on the developed online mobile payment technology and offline logistics facilities,taking the fast train of government’s entrepreneurship and innovation policy and China’s venture capital,the "China mode" of sharing economy is taking shape.Some share economy practitioners and venture capitalists believe that the era of China’s share economy is coming.When the sharing economy brings new development to our country,it also causes some problems to the current supervision mode.Sharing economy has the characteristics of cross industry,cross region and network.The current laws and regulations are not suitable for the development of economy.This case mainly from the perspective of sharing finance,such as regional equity trading market,crowdfunding,sharing transportation,such as online car hailing,sharing bicycle,etc.,according to the current situation of the development of sharing economy in China,the existing legal problems,and drawing on some foreign beneficial experience in the supervision of sharing economy,finally put forward measures to improve the sharing economy in China.At present,the main problems of China’s supervision lie in the following aspects: the problems caused by the imperfect system of laws and regulations,the "acclimatization" between the traditional supervision mode and the new business form,the lack of supervision by the supervision department,the local protection and other problems,as well as the weak supervision of the Internet platform on which the sharing economy relies,and the evasion of supervision and so on.All of the above problems are worth exploring in the field of sharing economy,and some of them have already happened,which has a negative impact on the current development of sharing economy.This paper mainly follows the idea of the combination of comparative research and empirical research,and discusses the necessity of innovation and reform of China’s regulatory system through the evaluation of real cases.Through the experience summary,combined with the supervision practice of our country,this paper puts forward the constructive innovation supervision suggestions to ensure the rapid and stable development of the sharing economy in our country.The open-minded and embracing technology attitude of the Chinese government is the software guarantee.The characteristics of the sharing economy platform are fast iteration and trial and error,and the natural and human participation of the main body has brought many regulatory problems to all countries,but the enlightened attitude of our government is the reassurance of its future development.Sharing economy stimulates the vitality of social resources in a broader scope and a deeper level,and improves the social and economic benefits.But the emergence and development of new things are difficult to avoid repetition and twists and turns,and the risks and problems in the process must also be paid full attention to.In order to prevent the legal risk of sharing economy and make sharing economy and crowdfunding bloom in the new era of digital civilization,consumers should consciously safeguard their rights and interests,operators should self-discipline supervise their operation,and regulators should be responsible for the organic governance system of the industry. |
