From a global perspective,the penetration of informatization and networking into the economic,political,cultural,social and other fields is becoming more and more obvious,and it has become a powerful driving force for promoting economic and social transformation,achieving sustainable development,and improving the country’s overall competitiveness.From a practical perspective,the great role of information and networking has become increasingly prominent:in the economic field,promoting the transformation of traditional industries and constantly spawning new economic forms;in the political field,changing the traditional political ecology and promoting the development of democracy and the rule of law;in culture In the field of society,it promotes great changes in the content,form and communication methods of culture;in the social field,it promotes changes in social structure and profoundly changes the lifestyles of members of society;in the military field,the ability of military struggle under the background of localization and networking has become national defense strength In the field of science and technology,the level of modern information technology and network technology has become an important symbol of national scientific and technological progress.Cross-border data is an important part of the development of global networks.Countries are competing to introduce corresponding policies and regulations to regulate cross-border data,and strive to master the international dominance of cross-border data regulation.In the cross-border data flow,the output of cross-border data is more complicated than the acceptance of cross-border data.At present,both the United States and the European Union have led the formulation of corresponding international cross-border data rules.China is also accelerating the introduction of corresponding policies and laws on cross-border data,but the focus is mainly on the level of personal data and data localization.Regulation,especially cross-border data output,is not sufficiently focused.Therefore,starting from the definition of cross-border data output rules,this paper studies the legal origin of cross-border data output rules and the existing rules and systems of cross-border data output at home and abroad.It can be used as a reference for the construction of cross-border data output rules with Chinese characteristics.To promote the establishment of China’s cross-border data regulatory system,it is necessary to clarify data sovereignty,classify and supervise data,and accelerate the introduction of cross-border data output legislation;clarify the power boundaries of various agencies to avoid law enforcement confusion;give full play to industry and enterprise self-discipline,and some Supervision authority can be delegated to the enterprise;coordinate the relationship between data localization and free flow of data,with equal emphasis on safety and efficiency;actively formulate international rules,strengthen international cooperation,and master the right to speak internationally.Through the above measures,the establishment and improvement of China’s cross-border data export rule system will be promoted,and the domestic status of China’s domestic data security and data governance will be maintained.
