Research On Peasants’ Litigation Divorce Cases From The Perspective Of Social Exchange Theory

This paper studies the problem of farmers’ litigation divorce.With the deepening of market mechanism and the development of opening to the outside world,the traditional orientation of marriage value has changed.Divorce may be a relief for the parties to the marriage,but it has a negative impact on the growth of the children involved in the divorce,has a negative impact on the stability of the family,and is not conducive to social stability and harmony.To study the problem of divorce among farmers,especially the problem of divorce by litigation,so as to minimize the negative impact of divorce.Based on the theories of Social Exchange Theory,social conflict and gender,this paper makes a statistical analysis of 500 rural divorce cases in XX community of Linfen by using the methods of Literature Research and investigation.The main contents of the article are: The first part is the introduction,which makes the technical foreshadowing of the paper;the second part,defines the relevant concepts and introduces the theoretical basis of the article;the third part describes the actual situation of farmers’ divorce,this paper analyzes the causes of farmers’ lawsuit divorce,points out that the current situation of farmers’ divorce rate is rising,and the fourth part analyzes the causes of farmers’ divorce rate rising,it points out that the reasons for the increase of the divorce rate are the improvement of the status of Rural Women,the reduction of the cost of divorce,the weakening of the inherent attraction of both husband and wife,and the increase of the substitution attraction.The fifth part has drawn the research conclusion,proposed the construction countryside harmonious marriage suggestion.The overall conclusion of this study is that the divorce rate among farmers is on the rise with the development of Socialist market economy and the acceleration of urbanization,the increasing divorce rate is influenced by four factors: one is the weakening of the couple’s intrinsic attraction due to the weakening of economic / emotional resources,and the other is the strengthening of social mobility,there are more alternatives for couples who live apart from each other,and the alternative appeal of both spouses is enhanced.Three is that the lower cost of divorce leads to impulsive divorce.Four is that with the improvement of women’s social status and the change of women’s roles,women’s quest for a better quality marriage and the courage to end an unhappy marriage have led to an increase in divorce rates.The divorce rate among farmers has increased at a faster rate in recent years.Marketization,urbanization and opening up have objectively pushed up the divorce rate of farmers.It is suggested to construct harmonious marriage and family relationship among farmers,for example,to guide farmers to set up the concept of marriage with the characteristics of the new era,to establish the equal gender order with the characteristics of the New Era;Establishing a new trend of ethics and morality in the socialist countryside with the characteristics of the new era.Some suggestions are put forward to reduce the divorce rate effectively: to strengthen the foundation of farmers’ marriage;to improve the marriage registration system;to strengthen the management of floating population in cities and towns;Improving the legal consciousness of farmers to maintain the stability and harmony of their families.
