Study On The Construction Of The Law Of The Inspector

The establishment of national supervision committee,this is the important link in the process of institutional reform of the State Council,its most essential attribute is the highest supervisory organs in the country,the government departments to perform supervisory duties,since our country started the "one house committee of both houses" era,have created a new situation in political structure,better adapt to the demands of a new age.There is also the "law of supervision" in this meeting was voted through,for the system of inspectors to carry out clear provisions,especially on the evaluation system,grade division,promotion space and other content.This paper states the concept of the supervisor and the supervisor system,and points out the necessity of the construction of the supervisor law.By analyzing the status quo of the regulator system in China,and found that there were problems,present the basic laws and institutions and personnel in place,although have normal operation,but the discipline inspection organs sequence is not unified,personnel management,professional quality is uneven,responsibility divided not clear,it is difficult to achieve efficient function of supervisory organs.These problems will bring that inspectors method,the difficulty in the building,need to consider many factors,and not against the value orientation of the supervisory system reform,the ephors law construction is not can complete,must summarize regulator system of ancient and modern,Chinese and foreign excellent experience,combined with China’s national conditions,construction inspectors method is more suitable to the actual situation in our country.Through historical analysis and comparative study,throughout the ancient system in China,responsible for the supervisory function of the regulator is recorded during the western zhou dynasty,qin and han dynasties formed outside system formally,sui and tang dynasties regulator system development,has been relatively mature,song and yuan period of unprecedented strengthening regulator system,the Ming and qing dynasties when mature,system perfect,clear rules,involving the ephors duties,selection,rewards and punishment,evaluation and other aspects.From a distant perspective,Plato’s judgment on the inspector in the Law Sense has long been found abroad,and Sweden,Britain and Denmark have recently developed the ombudsman system,which is quite mature.The analysis of the ancient and modern Chinese and foreign systems of inspectors,to take its essence,the establishment of the system of inspectors of our country greatly benefit.This article will focus on the ancient outside system at home and abroad,in particular,the post responsibility,selection system,encouragement mechanism,evaluation and supervision system of four dimensions,respectively,were analyzed,and the desirable experiences are summarized,and starting from the situation of our country,this paper puts forward the ideas of outside method to build on our,probes into the ephors duties,selection,encourage mechanism,evaluation and supervision.
