On The Specialization Of People’s Mediation In China

Civil mediation has played its unique’ role since ancient times.After the founding of the People’s Republic of China,a people’s mediation system with Chinese characteristics corresponding to the basic-level mass autonomous organizations was formulated according to my country’s national conditions.The people’s mediation system has the characteristics of autonomy,fast time,low cost,flexible form,and contact with the masses.However,with the rapid development of social reforms and economic progress,such a system with its own advantages has gradually languished and has gradually reduced to a dispensable point.At present,my country’s research on people’s mediation has achieved some results,but there are still some specific issues that are unclear.The need for mediation is increasing,the team building mechanism is not sound,the people’s mediation team lacks professional talents,people’s mediation is not closely linked to administrative and judicial mediation,and the fundamental role of the diversified dispute resolution system is not playing well.People’s mediation is no longer It is a reliable choice for the parties to seek a solution.To a certain extent,these problems reflect the imperfect functions of the people’s mediation system.In order to meet the needs of new dispute mediation,the industrialization of the people’s mediation system is an inevitable trend.Therefore,clarifying the scope of the people’s mediation system,improving the judicial confirmation procedures,and choosing a feasible way to professionalize people’s mediation are measures to break the bottleneck of people’s mediation development.This article studies the professionalization of people’s mediation,and takes the sustainable development of people’s mediation professionalization as the main goal.Based on our country’s research data on the professionalization of people’s mediation and personal deep understanding,summarize the connotation and necessity of the professionalization of people’s mediation.Through analyzing the practice and operation of people’s mediation professionalization in various parts of our country,the implementation of the non-governmental mediation system in foreign countries and my country’s Taiwan region,we summarize and draw on the lessons that are worth learning.In view of the current problems faced by people’s mediation in our country,analyze the reasons that restrict its development,absorb new insights put forward by relevant scholars,and propose ways to improve the professional construction of people’s mediation in our country,including clarifying the mediation areas of people’s mediation,standardizing mediation procedures,and improving design The professional mediation agent system,the construction of the people’s mediator system,the construction of the professional mediation platform system,and the optimization of the people’s mediator avoidance supervision system are expected to better develop people’s mediation and make the people’s mediation system a reliable choice for people to resolve disputes.The people’s mediation system should not be an alternative,but by leveraging its own advantages,it can become a unique and powerful mechanism for resolving conflicts and disputes.
