The People's Mediation Law's Implementation Situation,Problems And Countermeasures Research

The implementation of People's Mediation Law has improved the legalization level of people's mediation system,through which,significant changes from many aspects have been brought to people's mediation,including diversification of mediation organizations,increase in dispute mediation per capita of people's mediators.But the overall effect of the implementation of People's Mediation Law is unsatisfactory,various problems have occurred in practice,especially when during the course of social economy development,social environment is changing constantly,the mediation power of traditional village(community)people's mediation organization(hereinafter referred to as rural primary organization)has been weakened.The town(sub district)people's mediation organization has become the major power of dispute resolving.However,the town(sub district)people's mediation organization is administratively influenced,which is distinctly different from the “mass organization”property of people's mediation.In comparison,socialized utilization of new industrial,professional mediation organizations,along with traditional mediation organizations,has brought a new look to people's mediation,and it has evident social effects.How to develop and operate these kinds of mediation organizations requires a reference of experience from pilot areas,as well as foreign countries whose mediation systems are more advanced.Practice has proven that the social reform of people's mediation has become an important breakthrough for the innovative development of people's mediation system.The government must take on responsibilities to promote the reform.Through comparative analysis,People's Mediation Law has to be perfected in many ways,including the advancement in legalization,specialization,and professionalization of people's mediation.
