Research On The Mechanism Of Information Disclosure Confidentiality Review

The information that the administrative organs produce and obtain while performing duties constitutes the main body of governmental information disclosure.For modern governments,information disclosure is an obligation.Though the specific requirements of information disclosure vary among governments worldwide,they share the practice that some information falls into non-disclosure scope.As to China,the revised Regulation of the People’s Republic of China on the Disclosure of Government Information has,compared to the previous version,enacted more detailed requirements and specifications on non-disclosure information;and has stipulated that information disclosure should stand confidentiality reviews.The above-mentioned Regulation,supplemented with relevant laws and regulations like Law of the People’s Republic of China on Guarding State Secrets,has provided basis and guidance in carrying out information disclosure confidentiality reviews.Based on related data and situations concerning the practice of Shandong information disclosure confidentiality review,this thesis,the object of which is government information disclosure,discusses the existing problems and their causes.Disclosure and confidentiality,mutually complementary and contradictory,demonstrates problems at multiple levels,such as arbitrary confidentiality validation,inadequate confidentiality review,belated information disclosure,abuse of reviewing authorities,etc.Due to incomprehensive reviewing and regulation system,current practice of information disclosure confidentiality review is facing certain resistance,hindering the promotion of government information disclosure.Through measures like improving system construction and regulating non-disclosure information review,the problems could hopefully be addressed,thus ensuring that information disclosure is carried out in a strict and standardized manner.Carrying out research on information disclosure confidentiality review not only benefits the protection of state security and interests,but also guarantees transparency and proper utilization of information resources.This thesis aims at spotting the current problems of the information disclosure confidentiality review,analyzing the causes and proposing countermeasures,and eventually seeking a balance between safeguarding security and guaranteeing citizens’ rights of knowing.
