Research On Legislation Of Financial Consumer Benefit Protection In Laos

This paper focuses on the legislative issues of financial consumer protection in Laos.Firstly,it combs the previous research on the legislative evolution of financial consumer protection in Laos,explores the feasibility of the legislative protection of financial consumer benefit in theory,and summarizes the scholars’ theoretical research on the legislative protection of financial consumer benefit through the theoretical analysis of the legislative protection of financial consumer benefit It is the basic work for the analysis of the full text.Secondly,it focuses on the analysis of the current situation of consumer protection of financial stocks in Laos,the problems existing in the judicial relief of financial consumers,and the reasons for the increasing infringement of financial consumers’ rights in Laos.Whether the benefit of financial consumers can be guaranteed depends on the improvement of financial service mode,infrastructure,protection institutions and capital;the dispute resolution mechanism within financial institutions,the dispute resolution mechanism of financial supervision and management department,and the dispute resolution mechanism of Consumer Association and financial industry association in Laos are also discussed.This paper analyzes the foreign financial consumer rights relief.This paper makes a comparative study on the legal source,protection principle and operation effect of foreign financial consumer rights relief system.Finally,based on the discussion and research of the whole paper,the paper gives some suggestions on the construction of the legal system of financial consumer protection in Laos.Specifically,it includes further strengthening the improvement of financial consumer legislation;further strengthening the improvement of financial institutions’ obligation system;further strengthening the improvement of regulatory system;further strengthening the improvement of diversified dispute resolution system;establishing independent financial regulatory institutions.This paper discusses the improvement and development of the legislative protection system for the benefit of financial consumers in Laos,and proposes to establish a unified law on the protection of the rights and interests of financial consumers,clarify the concept of financial consumers,improve the information disclosure obligations of financial product operators,increase the penalty system of financial operators,improve the financial education system and establish the financial consumer compensation fund system in Laos Research.
