Research On The Course And Basic Experience Of The Construction Of The Party’s Internal Legal System Since The Founding Of New China

The inner-party legal system is the fundamental basis and important support for the comprehensive and strict administration of the party.Since its founding,the Communist Party of China has attached great importance to the construction of inner-party laws and regulations,from the first party outline to the previous party constitution,which is the embodiment of the continuous improvement of inner-party laws and regulations.But at present,there are still some problems in the construction of inner-party laws and regulations system that do not meet the needs of the actual development,the formulation of content is not targeted enough,the overall system is insufficient,and the establishment of a strict network of inner-party laws and regulations system is not built.This situation has not fully met the actual needs of comprehensive and strict administration of the Party and modernization of state governance.In view of this problem,a large number of domestic scholars have carried out research and achieved fruitful results,but most of the existing research has focused on this stage after the 18 th National Congress of the Party.The research focuses on the conceptual nature,significance,shortcomings,improvement path and the relationship between inner-party laws and state laws.The historical research method is used to sort out the course of the construction of the inner-party laws and regulations,to explore its development law,and to gain experience from it.On the basis of the existing research,this paper,using the historical research method,focuses on combing the development course of the construction of inner-party laws and regulations since the founding of New China,and obtains experience from it to guide the construction of inner-party laws and regulations in the new era.To form a modern inner-party legal system to provide experience support.This paper is divided into five chapters: chapter 1 is the introduction.Section 1analyzes the research background and significance of the construction of inner-party laws and regulations,and explains the basic value of this study.Section 2 focuses on the hot issues and basic conclusions of domestic scholars in inner-party laws and regulations.Section 3 is the main idea and concrete method of the study.Chapter 2 is an overview of the construction of inner-party laws and regulations.Section 1 expounds the related concepts of the inner-party legal system,clarifies the relationship between the inner-party system and the inner-party normative documents,and lays the foundation for the later research.Chapter 3 is mainly to trace the theoretical sources of inner-party laws and regulations.Section 1 expounds some viewpoints of Marx,Engels and Lenin on inner-party laws and regulations;Section 2 explores some important expositions of Party Central Committee leaders from Mao Zedong to Hu Jintao in inner-party laws and regulations;Section 3 studies Xi Jinping’s important ideas on the construction of inner-party laws and regulations so far,which provides theoretical support for this study.Chapter 4 is the main body of the article,mainly combing the development of the CPC’s inner-party laws and regulations since the founding of New China.Section 1combs the main contents of inner-party laws and regulations construction in the period of socialist revolution and construction,and section 2 studies the main aspects of inner-party laws and regulations construction in the new period of reform and opening up;Section 3 expounds the main measures of the construction of inner-party laws and regulations system of the Communist Party of China since the 18 th National Congress.Chapter 5 is the basic experience of the construction of inner-party laws and regulations.First,strengthen the Party’s leadership over the construction of inner-party laws and regulations.Give full play to the core position of the Party in the construction and strengthen the fundamental legal status of the Party Constitution;second,pay attention to the systematization and normative construction of the inner-party legal system.The third is to strengthen the supervision system of inner-party laws and regulations.Improve inner-party supervision laws and regulations and create multi-party supervision subject.
