Research On The Implementation System Of Inner-party Laws And Regulations Of The Communist Party Of China

Since its founding,the Communist Party of China has attached great importance to the construction of inner-party laws and regulations.At present,“a relatively perfect system of inner-party laws and regulations” has been formed.Standing at a new starting point,the construction of inner-party laws and regulations is in a period of development and upgrading from “increasing quantity and complete system” to “improving quality and giving full play to efficiency”.Therefore,it is particularly important and necessary to further establish and improve the efficient implementation system of inner-party laws and regulations,and give full play to the governance efficiency of “the rule of inner-party laws and regulations” in managing the party and ruling the country,as well as the rule of law advantage of leading and driving the development of national governance modernization.In this regard,this study aims to put forward a comprehensive management plan for the modernization of the implementation system of inner-party laws and regulations that actively adapt,forwardly serve and effectively ensure the development of the modernization of national governance.Macroscopically speaking,this study is generally based on the logical framework of “totalsub-total,which is specifically divided into “pandect” and “sub-pandect”: the “pandect” part consists of three chapters: “introduction”,“basic overview” and “relationship analysis”.The“sub-pandect” part is composed of four chapters: “dimension of interpretation”,“dimension of evaluation”,“dimension of supervision” and “dimension of popularization”.In addition,the“conclusion” part,as the summary of existing research and the expectation of future research.Microcosmically speaking,the main contents of each chapter are as follows:The introduction part points out that the inner-party laws and regulations system carries the important objectives and profound logic of national governance,and whether its implementation is effective or not is closely related to the full realization of the efficiency of national governance.Rooted in the local context of the modernization of national governance led by the Communist Party of China,starting from “the rule of inner-party laws and regulations”and “rule of China”,this study expounds the domestic and foreign background,academic and application value,and clarifies the two-dimensional research ideas of “phenomenon essence”and “experience logic”,as well as the research methods of norms and demonstration,qualitative and quantitative.Based on the literature review,the future academic research is prospected,and the innovation and deficiency of the research are pointed out.The first chapter is the basic overview,which defines the four system types and their connotation,implementation characteristics and requirements of the inner-party laws and regulations system,including “partial will type”,“quasi administrative type”,“heavy discipline type” and “strong unified publicity type”,and expounds the internal function of the inner-party laws and regulations system implementation system to the inner-party rule of law and governance and the external function to the national rule of law and governance.At the same time,it makes a distinction between the static implementation system and the dynamic implementation efficiency system.Focusing on the coordinated development and operation conditions of the whole implementation system of inner-party laws and regulations,this paper systematically analyzes its value,subject,system and procedure.The second chapter is the relationship analysis part,which dialectically discusses the important relationship between the implementation system of inner-party laws and regulations,gives a deep perspective from the four dimensions of its “attribute”,“procedure”,“function”and “development”,expounds the coupling relationship between the implementation system and the national governance system,the implementation ability and the national governance ability,and analyzes the overflow and modesty of implementation abstraction and clarity,as well as the interactive relationship between “the rule of inner-party laws and regulations” and the party’s overall leadership and public administrative governance.In addition,based on the perspective of development,it points out the interdependence between the stability and variability,modernization and dependence of the implementation system of inner-party laws and regulations.The third chapter is the dimension of interpretation,which clarifies the theoretical points of the interpretation of inner-party laws and regulations and the practical attribution of its role in the implementation of regulations,and points out the important functions of the predictability and guidance of the interpretation of inner-party laws and regulations in clarifying the abstract provisions of the system,filling the loopholes of system norms,coordinating governance relations,consolidating legal supervision and so on.This study analyzes the deficiencies and deficiencies of interpretation in system network,linkage degree,procedural norms and legal construction in the process of implementing regulations,and then puts forward the modern development road of systematization,linkage,standardization and legalization of interpretation of inner-party laws and regulations.The fourth chapter is the dimension of evaluation,which demonstrates the systematic governance effectiveness of the implementation evaluation of inner-party laws and regulations in “the rule of inner-party laws and regulations”.Based on the “process and result” oriented circle,it is divided into six evaluation types,combined with the two-dimensional empirical study of “central and local”,and analyzes the subject composition of “multiple participation”and “responsibility related”,the object selection of “article elements” and “space-time conditions”,the design of “macro comprehensive” and “essential deletion” indicators,and the application of “one-way implementation” and “overall consideration” achievements,and then puts forward the road of modernization and improvement of returning to system,returning to value,reviewing the scene and returning to governance.The fifth chapter is the dimension of supervision,which emphasizes the core of the supervision system for the implementation of inner-party laws and regulations,systematically analyzes the design and operation of the responsibility mechanism for the implementation of regulations,the key subject of the party’s leading cadres,expounds its deep governance meaning,and makes a normative deconstruction from the four dimensions of responsibility.For the implementation incentive,this study demonstrates the three-dimensional incentive mechanism structure of “horizontal and vertical” interface,“internal demand and external force”gradient and “rights and remedies” attribution and its three governance functions such as guidance,forward-looking prediction and risk resolution,then analyzes its lack of operation and puts forward the way forward for its modernization.The sixth chapter is the dimension of popularization,which introduces the connotation of the popularization of inner-party laws and regulations and its dual function of “the rule of law and governance”,analyzes the internal elements of regulations popularization,and discriminates the dual relationship between enhancing the political ability of regulations and enhancing the tension,diffusing the spillover effect of regulations and transmitting pressure.Based on the horizontal role of internal compliance and external guidance,this study makes a normative analysis of the four-dimensional framework of “publicity”,“education”,“compliance” and“application” of the general regulation system.Aiming at the governance needs of “the rule of inner-party laws and regulations”,this study puts forward the road of modernization and innovation from four aspects: value governance,behavior governance,discourse governance and mechanism governance.The conclusion part clarifies the multiple governance aspects of the modernization of the implementation system of inner-party laws and regulations to “party governance” and “national governance”,and puts forward that we should pay attention to the extension from “internal ability” to “external effect”,and improve its adaptability and responsiveness to government governance,social governance and grass-roots governance.Finally,based on the macro deployment and micro layout of the “efficient implementation system of inner-party laws and regulations”,this study constructs a multi integrated comprehensive management plan for the development of the modernization of the implementation system of inner-party laws and regulations that covers four aspects: the modernization of the formulation system,the modernization of the executive ability,the modernization of the statute mechanism and the modernization of the effectiveness of publicity and education.
