At present,the main subject of investigation of environmental pollution crime in China is the environmental investigation departments of public security organs at all levels.There is a close connection between the investigation of most environmental pollution crimes and the law enforcement of administrative organs.Under the current system,there is no smooth connection between environmental administrative law enforcement and criminal justice.Investigators are also ill-equipped to deal with such cases.And the subject of investigation is difficult to get rid of the intervention of regional protectionism.Mainly because there are problems in the current investigation system.As the investigation can only be carried out by public security organs,the connection of "two laws",is unsmooth and the public security organs lack the ability to investigate environmental pollution crimes.The low level of synergy is caused by the"combination of strip and block".And the "block-based" provides space for regional protection.Under the current investigation system,the problems existing in the investigation of environmental pollution crimes can be solved by constructing professional investigation teams,setting up investigation organizations which break administrative division,improving the cooperation mechanism and the supervision mechanism.Furthermore,the model of the integration of environmental law enforcement and investigation in the United States can also be used for more thorough reform.That is to break the monopoly of the public security organs on investigation.Entrust limited criminal investigation power to ecological and environmental law-enforcement departments,break the system of "combination of strip and block" and "block-based",implement vertical management and reduce the administrative level.In order to get rid of local intervention,the establishment of investigation subject should break administrative division.We should also build an effective supervision mechanism,strengthen the supervision of the procuratorial organs,establish the supervisory position of the supervisory organs,and combine various supervisory means to form a joint force of supervision.
