With the continuous progress of network technology,telecommuting has gradually become popular.In particular,affected by the epidemic in 2020,China’s economy has been hit hard,and telecommuting has become a new choice for many enterprises to overcome the difficulties under the epidemic.The difference between telecommuting and traditional office work is that it breaks the limitation of time and space of the traditional way of working and uses modern Internet equipment and communication technology to complete the work anytime and anywhere.Although the appearance and development of telecommuting have changed people’s traditional way of working,new problems have also arisen.At present,China still lacks relevant laws and regulations to protect the labor rights and interests of telecommuting workers.Specific manifestations are as follows:The current labor law defined for telecommuting labor relations,telecommuting workers apply the current standards of difficulties,under the current legal framework for telecommuting laborer inductrial injury is not easy to maintain,there is no guarantee that telecommuting laborer counterpoises,telecommuting workers lack of personal information protection,remote office worker mental health problems are more prominent,etc.In order to better solve the practical problems brought by telecommuting,it is urgent to study the related problems of the protection of labor rights and interests of telecommuting workers.This paper starts with the related concepts of telecommuting,focuses on the special labor rights and interests of workers under telecommuting,summarizes the current situation of the protection of labor rights and interests of telecommuting workers in China and the current difficulties encountered,and analyzes the causes of the difficulties.Paper based on the reality of our country,in a reasonable absorption of other country for telecommuting workers labor rights protection on the basis of experience,put forward for telecommuting workers labor rights and interests of the security in our country should adopt infiltration mode of legislation,improve the labor relations in the current labor law determination,establish telecommuting workers calculate standard,Further defined the cognizance of telecommuting laborer inductrial injury problems,establish a sound security regulations for telecommuting laborer counterpoises,using its own unique advantages in telecommuting by special way to ensure the telecommuting employee personal information,and finally,establish and perfect guarantee telecommuting workers related measures of psychological health in our country and the laws and regulations.It is hoped that through strengthening the protection of labor rights and interests of telecommuting workers,stable and harmonious labor relations can be achieved.
