As an important measure for police departments to maintain public order,confinement can be implemented in the forms of short-term jail or temporary custody.This article tends to address important issues about power abuse of police authority over confinement.These issues shall be deliberately tackled because they always have significant influence on public interests and individual rights.This article also focuses on alleviating power abuse of police departments in respect of confinement.In specific,Firstly we should clarify the relationship between police authority over public order offenses and the citizen’s right of personal liberties.The two represent two different value orientations,namely,the view of illegal control and the view of rights protection.Police departments should take the protection of citizens’ basic rights as their primary goal in exercising public order offenses.And the protection of the basic rights of citizens requires police departments to improve the executing level.In practice,the power abuse of police departments in respect of confinement is common.Generally speaking,it can be summarized as four types of performance that overstep the authorization of the law,abuse of discretion,violation of legal procedures,and violation of legal principles,which is harmful to citizens,the country,and society.Existing laws,power structure,administrative management,internal evaluation,procedure of defending oneself and supervision systems will all be reviewed for finding reasons of the unjust status quo.Therefore,laws and regulations supervise police authority over public order offenses should be as follows:Firstly,to legislative norms should deliberately restrict personal freedom,whether the legislative ideas or legislative techniques.Secondly,to reduce the excessive reliance on local personnel and finance,so as to improve the independence of police departments.Thirdly,to pay attention to the construction of grass-roots police force and optimize the internal evaluation.Fourthly,to establish a defense mechanism to implement procedural justice.Fifthly,to improve the supervision mechanism,which should strengthen the supervisory leverage of the administration,the judiciary,and the social media,and form a check and balance effect on the police authority over public order offenses.
