Research On The Grandparents Guardianship System Of Left-behind Children

Under the influence of economic and social transformation and upgrading,a large number of left-behind children have appeared in my country.Due to the particularity of the environment,the problems of left-behind children are prominent.These problems are not only the problems of left-behind children themselves,but also issues that deserve the common attention of the country and society.Left-behind children are persons without or with limited capacity for civil conduct,and their growth cannot be separated from guardianship.Most of the problems of left-behind children are guardianship problems.According to the data in the "Report on the Status of Left-behind Children in Rural my country-2016 National Rural Left-behind Children Investigation Work Summary",more than 90% of the guardianship types of left-behind children in rural my country are inter-generational guardianship.Affected by the parent-child relationship passed down through history,most of the left-behind children in cities and towns are also under inter-generational guardianship.The Civil Code and the Law on the Protection of Minors have stipulated the inter-generational guardianship system for left-behind children in my country,but they still cannot regulate the problems that arise in the inter-generational guardianship of left-behind children.Therefore,in order to effectively protect the legitimate rights and interests of left-behind children,the study of its intergenerational guardianship system is the first to bear the brunt.This article is divided into six parts: The first part is the introduction.It explains the background,purpose and significance of choosing the intergenerational guardianship system for left-behind children as the research object,and briefly summarizes the research on the intergenerational guardianship of left-behind children by domestic and foreign scholars.Results.The second part defines the concepts of left-behind children,guardianship,inter-generational guardianship and left-behind children’s inter-generational guardianship,highlighting the particularity and necessity of left-behind children’s inter-generational guardianship.The third part introduces the historical evolution and current situation of the intergenerational guardianship system for left-behind children in my country.The fourth part analyzes and summarizes the problems of the inter-generational guardianship of left-behind children in our country and theirinstitutional causes,and draws the conclusion that the definition of left-behind children is vague and inconsistent,the lack of a unified expression of "inter-generational guardianship",and the provisions of the inter-generation guardianship system for left-behind children Over-principle,lack of legal responsibility for the intergenerational guardianship system for left-behind children,imperfect procedures and regulations for the intergenerational guardianship system for left-behind children,and lack of supporting supervision in the system.The fifth part summarizes the content of the intergenerational guardianship system for minors abroad,summarizes the useful experience,and provides ideas for the improvement of the intergenerational guardianship system for left-behind children in my country.In response to the deficiencies pointed out in the fourth part,the sixth part proposes a unified expression of “intergenerational guardianship of left-behind children” one by one,formulates more specific special regulations for the intergenerational guardianship of left-behind children,specifies the eligibility conditions and specific provisions for the guardianship of intergenerational guardians Seven perfect suggestions include the content of rights and obligations in the inter-generational guardianship of left-behind children,clarification of the legal responsibilities of the inter-generational guardianship system for left-behind children,standardized procedures for the inter-generational guardianship of left-behind children,and establishment and improvement of the intergenerational guardianship and supervision system for left-behind children.
