| The public lawyer system is an important institutional arrangement of the legal integration construction.The choice of its management model is the key to its effectiveness.The public lawyers have the characteristics of duality of identity,internality of services,multi-directional supervision and gratuitousness of services.They play an important role in decision-making review,risk prevention and control and the cultivation of the concept of rule of law.In the long-term practice and operation,the public lawyer system has produced four typical modes:“employee contract management system”,“public lawyer office management system”,“full-time law firm and part-time department concurrent management system”and“unit and judicial administrative organ dual management system”.Various models not only meet the advantages required by the actual development of public lawyers in China,but also have challenges that affect the collectivity,independence and professional performance of public lawyers.The public lawyer management model of“centralization+typification” combines the advantages of each typical model.It is a transcendence and development of the traditional model,which can largely guarantee the efficiency of administrative decision-making,the legitimacy of administrative power,and legal services quality.In the process of building the public lawyers management model of“centralization+typification”,we should follow the basic principles of integrity,difference,independence,and professionalism,with centralization and typification as the main line.Centralized management can integrate the resources of the government’s law and the type setting can guarantee the professionalism of public lawyers.At the same time,we should also revise the relevant laws of the Lawyers Law of the People’s Republic of China and the Civil Servants Law of the People’s Republic of China,and improve the supporting systems for the selection,promotion and training of public lawyers. |
