In recent years,food and drug safety problems such as "Fake and inferior vaccine","Clenbuterol","Yogurt made of leather" and " Hogwash oil" have attracted wide attention of the people and the government departments.The emergence of these problems reflects the loopholes in food and drug supervision in China,and exposes the absence and deficiency of the government’s public management functions.In order to make the administrative law enforcement departments as the main body of food and drug supervision and the criminal judicial organs responsible for cracking down on food and drug crimes in a timely and efficient manner,form a perfect food and drug execution linkage working mechanism,launch a fierce attack on food and drug crimes,create a good food and drug safety environment,and effectively protect the people’s life safety and health Kang,how to improve the convergence mechanism of food and drug administrative law enforcement and criminal justice from the aspects of legal norms,mechanism improvement,work development,supervision exercise and so on,has become a key issue for the government to realize the modernization of social governance.This paper is based on this background.Through the interpretation of the related concepts of food and drug execution cohesion,this paper expounds the current research status of food and drug execution cohesion at home and abroad.This paper analyzes the current situation of the convergence of food and drug administrative law enforcement and criminal justice in China from the theoretical provisions and practical operation,and puts forward the following problems: the operation of food and drug joint working mechanism is not smooth,the identification of the nature of the goods involved in the case needs to be improved,the administrative law enforcement departments have the phenomenon of "replacing punishment with punishment" and "not moving a case".The author analyzes the above situation and problems from the construction of the connection mechanism of execution,transfer of cases,low enthusiasm of investigation work,and puts forward suggestions for the improvement of the connection between administrative law enforcement and criminal justice of China’s food and Drug Administration from the aspects of system improvement,power construction and working mechanism,including improving the system guarantee of food and drug execution connection mechanism and clarifying food In the practice of food and drug execution convergence,we should improve the construction of food and drug safety information platform,improve the coordination mechanism of food and drug execution convergence,improve the construction of food and drug police force,improve the quality of administrative law enforcement personnel,and implement the mechanism of execution convergence and accountability The mature and efficient food and drug execution linkage mechanism will promote the development of food and drug supervision in China,improve the management ability and professional level of the government in this field,and create a good food and drug safety environment for the people.
