| At present,the development of network technology gave birth to the prosperity of the e-commerce industry and brought great convenience to production and people’s lives.While the e-commerce economy is booming,it also breeds unfair competition behaviors of false propaganda on the Internet.In order to gain more benefits and seize the market,electronic merchants rely on the convenience and virtuality of Internet technology to use false advertisements,scramble letters,etc.to make unrealistic and false propaganda on the products and services they sell and mislead consumers.Make consumption choices.The false propaganda behavior of e-commerce operators will cause serious damage to the rights of consumers,other operators,and the order of the market economy.There is a need to continue to implement comprehensive legal regulations and oversight to create a fair and equitable online market operating environment and realize business interests.A win-win situation with the convenience of the consumer.However,at present,my country ’ s "Anti-Unfair Competition Law","Advertising Law","E-commerce Law" and other legal provisions for false propaganda of e-commerce networks are still insufficient,unable to carry out comprehensive regulation and control,and conduct false online propaganda behaviors of e-commerce.The penalty rules of China also urgently need to be improved.This article is divided into five parts.The introduction of the first chapter introduces the background and significance of false propaganda on e-commerce networks,the current research status of this issue at home and abroad,as well as the research methods and innovations adopted in this article.The second chapter is an overview of e-commerce network false propaganda.It discusses in detail the concept of e-commerce network false propaganda.Its characteristics include the technicality of the means,the diversity of methods,the wide range of communication and the speed of communication,and the false propaganda of e-commerce network The main manifestations are false advertising and promotion,false product parameters,false order speculation,and online navy incitement.Based on this,it is proposed that legal regulation of e-commerce false propaganda has the right to maintain fair competition,safeguard the legitimate rights and interests of consumers,and purify the online market.The competitive environment is necessary to promote the healthy and prosperous development of our country’s economy.The third chapter analyzes the current legal regulation of false propaganda in electronic commerce networks in my country and analyzes the gaps in the current legal provisions of the "Unfair Competition Law",the "Advertising Law" and the "Law on the protection of consumer rights".and “ Electronic Commerce Law ” The main issues are: unclear constitutional requirements,imperfect legal liability regulations,imperfect platform obligations,imperfect oversight and control mechanisms,and difficulty in determining the jurisdiction involved in the case.The fourth chapter concerns legal regulations and the reference to false propaganda from e-commerce networks outside the territory.By analyzing the laws and regulations of common law countries represented by the United States and civil law countries represented by Germany and Japan,the laws and regulations of false propaganda on the Internet are Research,summarize its strengths,and provide reference for my country to improve relevant laws and regulations.The fifth chapter puts forward suggestions for improving the legal regulation of false propaganda in my country’s e-commerce network,mainly in the following aspects: First,clarify the constituent elements of e-commerce network false propaganda behavior,and clarify the behavior of e-commerce network technology for false propaganda.Define;secondly,improve the legal liability regulations for false propaganda behaviors of e-commerce networks,so that the regulation of false propaganda behaviors can be followed by laws and regulations;at the same time,a complete e-commerce obligation specification must be formulated,and finally,the improvement of e-commerce Supervision and supervision mechanism recommendations. |
