Study On Contemporary Chinese Circuit Court System

In October 2014,the Fourth Plenary Session of the 18 th CPC Central Committee proposed that "the Supreme People’s Court set up circuit courts to hear major administrative and civil and commercial cases across administrative regions." The judicial reform proposed by this meeting has attracted wide social attention.The circuit court is still in the initial establishment stage,and will also expose some problems in the operation process.If these problems cannot be discussed and solved in time,then the purpose of the circuit court cannot be successfully realized,and even sometimes reduce the judicial efficiency,resulting in the waste of judicial resources.The first part of the article mainly introduces the background and basis of the establishment of the circuit court,based on the development of the circuit court,summarizes the emergence and development of the circuit system in Chinese history,deeply studies the root of the application of the circuit trial in China,and finds the historical basis of the establishment of the circuit court.Then the definition and nature of the circuit court and the circuit trial system are expounded,the characteristics of the circuit court and the function of the circuit court are discussedThe second part discusses the value of the circuit court,focuses on analyzing the significance of the circuit court in the prevention of wrongful,adjusting the relationship between central and local governments and promoting the modernization of the rule of law,and lists the value brought by the establishment of the circuit court.The third part points out the current situation and difficulties of the current China Circuit Court,points out the problems encountered in the actual work of the Circuit Court and the root causes of the problems.In order to explore a suitable operation plan for China,we should deal with these problems in a timely and effective manner.The fourth part enumerates the development and current operation of the circuit trial mechanism,which is mainly represented by Britain and the United States,understands its development process,and through "taking its essence out of its dross "," takes lessons" for the domestic circuit court,makes some reference significance for the universality of the contradiction,and provides some ideas for solving the practical difficulties of the circuit court operation in our country.It is believed that the reform of the court organization structure in our country can be used for reference.The fifth part is to solve the problems of the circuit court,from the original position of the circuit organization,from the legislation,the specific operation of the circuit court,supervision mechanism and other aspects of the circuit court organization put forward some suggestions and perfect methods,in order to improve the construction of China’s circuit court organization system.
