Research On Criminal Circuit Trial System

As a system of convenience and benefit,the circuit trial system is developed from the common law system in the west.Although the assizes in developed countries such as Britain and the United States system gradually declined or evolved into other convenient judicial service system in our country,but after a long period of development and improvement,has become a Chinese with local characteristics of the system,has become an important part of our litigation system.With the process of the rule of law,judicial reform,on a trial of the criminal case also highlights the unique value of litigation,the Supreme Court and the circuit court of the establishment and implementation of the circuit trial system has become a focus in many courts respected.The criminal trial system is of great significance to the improvement of the socialist rule of law and the rule of law.This article is divided into five parts: the first part starts with the overview of the circuit trial,discusses the concept and historical development of the circuit trial.The second part starts with the characteristics of our country "s criminal trial,and probes into the characteristics of the criminal circuit trial and the criminal trial of the Supreme Court circuit.The third part discusses the significance of criminal circuit trial from the value and function of criminal circuit trial.The fourth part discusses the shortcomings and defects of the criminal circuit trial,from the basic criminal circuit and the Supreme Court circuit criminal trial to analyze the problem.The fifth part of the criminal assizes put forward suggestions,through the improvement of the two aspects of the circuit court of grassroots courts and the supreme law,to ensure that criminal assizes system play its unique advantages and value fully.In this paper,the author thinks that the criminal justice system should be carried out in two aspects: the Supreme Court circuit court and the basic court.For the application of criminal justice to local conditions,can not be generalized,but can not blindly pursue formalism.It should be used reasonably to maximize the function of the system.This article has carried on the system detailed analysis to the criminal trial system,and has put forward the perfect suggestion to the question.
