| The criminal policy of combining justice with leniency requires that criminals should not only be punished by law,but also be educated and reformed.In recent years,the criminal reconciliation system in the criminal justice reform,the system of conditional non-prosecution of juvenile suspects,and the gradual establishment and implementation of the lenient system of pleading guilty and punishment are its concrete embodiment.As far as interrogation is concerned,on the one hand,it is a powerful means to obtain the confession of criminal suspects,on the other hand,it is also one of the important links of probation and education for criminal suspects.The Method of Emotional Influence helps to realize the tasks of these two aspects.It is an interrogation method that conforms to the situation and development trend of criminal justice reform in our country,and should be fully used in interrogation.Based on this,this paper follows the idea of combining theoretical research with practice,first combs the basic theoretical research of Emotional Influence Methods,and then understands the current situation of the use of Emotional Influence Methods in interrogation through empirical investigation.This paper focuses on the analysis of the shortcomings of this method in practice,and finally puts forward improvement countermeasures on the basis of summary.The paper is divided into five parts:The first part is the introduction.It mainly expounds the research purpose and significance,research status,research ideas and methods of this paper.The second part is the general principle of the Method of Emotional Influence.First of all,it defines the meaning of the research object,then expounds the psychological theoretical basis of the Emotional Influence Method on the basis of summarizing the existing research,and finally discusses the value of the Emotional Influence Method in the criminal justice level and the practical level of interrogation.The third part is the present situation of the use of motional probation methods in interrogation.This chapter uses the empirical research method,selects some investigators and detainees to conduct a questionnaire survey,and describes the basic situation of the use of this method in interrogation according to the results of statistical analysis.The fourth part is the problems in the use of Emotional Influence Methods.Combined with the results of empirical research,this paper makes a more comprehensive summary of the problems existing in the use of Emotional Influence Methods,such as: investigators lack of mastery of Emotional Influence Methods,lack of relatively fixed use pattern;lack of preparation before the use of Emotion Influence Methods;lack of skill in the use of Emotion Influence Methods.The fifth part is the countermeasures to improve the use of Emotional Influence Methods in interrogation.The first is to refine the essentials of the use of Emotional Influence Methods;the second is to pay attention to the skill of Emotional Influence Methods;the third is to use Emotional Influence Methods according to the characteristics of criminal suspects;the fourth is to strengthen the training of investigators to make up for the deficiency of professional knowledge. |
