Study On The Perfection Of Juvenile Criminal Legal Aid System In China

Entering the new era,the CPC Central Committee with Comrade Xi Jinping as the core has paid more attention to the healthy growth of minors,and at the same time,all sectors of society have never reduced their concern for the prevention and protection of juvenile crimes.In 2020,major revisions were made to the Law on the Protection of Minors and the Law on the Prevention of Juvenile Delicency,both of which are the sister laws,which once again set off a huge wave of discussion on minors.Nowadays,the minimum tolerance of the challenger society is the sensational public events of minors.The juvenile criminal legal aid system,as the supporting system of "the law on the protection of minors" and "the law on the prevention of juvenile delinquency",should also be adjusted accordingly to respond to the social concerns.Based on this,this paper discusses how to further improve China’s juvenile criminal legal aid system,the purpose is to make the supporting system of juvenile criminal legal aid system as the "Minor Protection Law" really rooted rather than in vain.This paper is divided into three parts,the first part is the juvenile criminal legal aid system overview.This part mainly elaborates on the relevant theoretical knowledge of minors.First,the connotation of the system;Second,the characteristics of the system;The third is the value of the system.Through the introduction of the first part,the purpose is to show the necessity and importance of the existence of the system.The second part is the present situation and realistic predicament of juvenile criminal legal aid system.Through the analysis of the actual operation of the system,and then found that the system in the practice of the operation of the problems.Although the provisions of this system have been very comprehensive,in judicial practice there are some issue,for instance the low rate of legal aid in the pre-trial stage,The connection and coordination of each link are not ideal,and the low quality of defense.The third part is the perfect path of juvenile criminal legal aid system.This part is aimed at the dilemma of the system in practice,on the improvement of juvenile criminal legal aid system,put forward their own thinking.Such as the establishment of the corresponding procedural sanctions,the establishment of minors comprehensive information sharing platform,the establishment of professional legal aid team,strengthen the quality supervision,improve the financial security and other measures.
