With the development of Internet economy,online games have developed rapidly in China.The booming online game market has promoted social economic development and enriched people’s spiritual life.With the improvement of people’s living standard and the change of consumption concept,people’s investment in online games has reached an unprecedented scale.However,it brings a variety of infringement risks of virtual property.Due to the imperfect legislation of virtual property,it is difficult for online game players to make up for their losses and effectively safeguard their legitimate rights and interests when they suffer from infringement of virtual property.Under this background,virtual property insurance arises at the historic moment.China’s first exploration of virtual property insurance began in July 2011.The world’s first virtual property insurance was launched by sunshine insurance group.The insurance is based on Juxian,a large-scale role-playing game developed by GAMEBAR,an online game company.The development of virtual property insurance has played an important role in protecting the legitimate rights and interests of players,dispersing the risks of online game operators and enriching China’s insurance market.However,the development of China’s virtual property insurance is still immature,many legal problems need to be solved,and theoretical research is insufficient.It is necessary to speed up the research pace of China’s virtual property insurance legal system.Specifically,this paper is divided into four partsThe main content of the first part is an overview of the related concepts involved in the virtual property insurance,which defines the virtual property as a narrow sense of virtual property,that is,all kinds of property existing in the online game,the account number owned by the players and all kinds of property in the account number,and expounds the risks faced by the virtual property,At the same time,it analyzes the characteristics,classification and legal relationship of virtual property insurance.The second part combs the current situation of the development of virtual property insurance in China,summarizes the defects in the virtual property insurance contract,such as the difficulty in regulating the insurance agreement,the difficulty in defining the subject matter of insurance,and the difficulty in evaluating the value of virtual property The disputes of the ownership of virtual property may hinder the establishment of the legal system of virtual property insurance.The third part analyzes the necessity of establishing the legal system of virtual property insurance from the perspective of game players,online game companies and insurance industry.The establishment of the legal system of virtual property insurance can effectively protect the virtual property of players,promote the innovation of the insurance industry,and guide operators to avoid risks.The feasibility is analyzed from the perspective of insurability and insurable interests.In the fourth part,on the basis of problem analysis and combining with the actual situation of our country,focusing on solving the obstacles in the construction of the legal system of virtual property insurance,from the perspective of the relevant legislation,supporting system and specific content of virtual property insurance,the author puts forward some innovative and targeted Countermeasures for the establishment of the legal system of virtual property insurance in our country.
