Research On The Legal System Of Product Certification

Product certification system is the third party to prove that the product meets the product standard system.In order to achieve a better life,people have put forward higher requirements for product quality.Product certification legal system,as the basic institutional arrangement of national quality management,has become an important part of economic and social governance,reflecting the value pursuit of the society for quality safety,quality order,quality credit and quality efficiency.Exist in the current legal system of product certification legislation flaws and vague understanding of standards,product certification agency access incomplete,insufficient government regulation,legal liability mismatch and so on,so we must re-examine the theoretical basis,which is the basis of the legal system of product certification history foundation,realistic foundation,to provide benefit to the improvement of the legal system of product certification.Following the basic research path of the product certification legal system of "connotation--value--norm--guarantee",this article mainly analysis "Government-Product Certification Body-Certification Entrusting Party(enterprise)-Certification Consumer(consumer)" the legal relationship between the four for the paint,to discuss the standard(legal)system,legal system of admittance of product certification,product certification supervision legal system,product certification the lack of legal responsibility for the perimeter,starting from the basic theory of product certification,The constitution condition,characteristic and function of product certification are summarized.This paper probes into the origin of the certification,considers that the product certification originated from the requirement of productivity development in essence,compares the reasons why the ancient system of " Engraving the name of the craftsman on the product " in China failed to evolve into the modern system of product certification,and introduces the development course of product certification.This paper reviews the changes and evolution of the legal system of product certification before and after the implementation of the Regulations on the Management of Product Quality Certification and the Regulations on Certification and Accreditation,and discusses the core contents and institutional characteristics of the legal system of product certification in different periods.Combined with the current product certification mess,on the basis of general observation and specific discussion of the problems existing in the legal system of product certification in China,this paper summarizes the causes and hazards of the problems existing in the legal system of product certification in China.On the premise of summarizing the legal system of product certification in the United States,Japan and the United Kingdom,the generality and individuality of these systems are compared,which provides a possible reference for perfecting the legal system of product certification in China.Finally,this study provides general ideas and specific suggestions for improving the legal system of product certification in China.
