| Stakeholder cybercrime is a new type of crime that relies on science and technology.Compared with traditional crimes,it has the characteristics of stakeholder,cross-regional,and virtual.Evidence is indispensable to punish them in accordance with the law,and stakeholder cyber crimes mainly occur in virtual spaces,making investigation and obtaining evidence significantly more difficult.In the process of obtaining evidence for a stakeholder cybercrime,many problems have emerged,mainly including the lack of professionalism of the forensic subject,the irregular procedures for obtaining evidence,and the impact of the proving ability and power of electronic data.These problems have severely hindered the comprehensive,objective,and timely collection of evidence by the judicial organs of investigative agencies to combat cybercrimes involving stakeholders.The main evidence for identifying the stakeholdertype cybercrime is electronic data.Therefore,the discussion on the evidence collection and problems of the stakeholder-type cybercrime is centered on electronic data.Aiming at the problems in the process of obtaining evidence for a stakeholder cybercrime,it should be based on the characteristics of the stakeholder cybercrime,the evidence collection system,and combining the characteristics of electronic data variability,fictitiousness,and easy and accurate reproduction,to find specific and effective results.The problem countermeasures.This article is mainly divided into four parts,the introduction part mainly explains the background of the topic.Through combing the current important domestic and foreign documents,clarify the main issues,research ideas and research methods in the process of obtaining evidence for the stakeholder cybercrime,and provide a theoretical basis for the analysis and discussion of the following three chapters.The first chapter mainly introduces the concept,characteristics and evidence collection system of the stakeholder cybercrime;the second chapter mainly explains the problems in the evidence collection of the stakeholder cybercrime in my country,and explores the reasons for its occurrence.The third chapter mainly elaborates on the countermeasures to the problem of collecting evidence for public-stakeholder cybercrime in my country. |
