Research On The Legal Supervision Of Network Live Broadcast

The network live broadcasting continuously creates the value of material and spiritual level,makes it develop and progress continuously,and goes through four times of live broadcasting.In the process of development,webcast has fallen into the wrong path of constantly enlarging the pursuit of material value and belittling the spiritual value,resulting in a variety of live chaos,such as false propaganda,malicious poaching and negative externalities,which need government supervision.The government is cautious and tolerant of the new format of internet live broadcasting,actively treats new things and protects its innovation,and adopts the cooperative supervision mode.Cooperative regulation is based on market failure,government failure and responsive regulation.Under the legal protection,the government,the webcast platform,the self-discipline organizations of the webcast industry and the society cooperate to supervise the webcast in an all-round way.Based on the current situation and problems of webcast legislation and four party cooperation supervision,supervision has not fully played the role of "one plus three is greater than four".We need to analyze the existing problems and provide a path for improving supervision.The United States,the United Kingdom and Germany are selected as representatives to provide experience and enlightenment for China’s legal supervision of webcast from the aspects of legislation,government supervision,industry self-discipline and public media literacy cultivation.The legislation of webcast is the premise and guarantee,but there is still room for improvement in the number,rank and content of the special laws related to webcast.When the government supervises the webcast,it is based on the level of the webcast platform to supervise the whole process,only when the anchor and users break the law,so as to improve the efficiency of supervision.When the network live broadcasting platform is autonomous,it is based on the internal market of the platform and relies on the platform rules and technology to supervise the whole process of the anchor and users.The construction of self-discipline organizations and the effectiveness of self-discipline norms in the webcast industry need to be strengthened and play a key role.For social supervision,on the one hand,we should strengthen the cultivation of media literacy,on the other hand,other parties should encourage and protect public supervision.
