Research On Legal Supervision Of China's Webcast Platform

As an important part of the Internet cultural industry,the webcast platform has made great contributions to the development of Internet cultural industry in China,and has promoted a new revolution in the new round of Internet and cultural circles.However,due to the imperfections of the current regulatory system,low barriers to entry and weak supervision,there have been many controversies since the birth of webcast platform.Therefore,the research on the legal supervision of the webcast platform has certain practical significance.At present,there are the following problems in the supervision of the webcast platform in China.Firstly,on the webcast platform operation aspect,there are many problems,such as the worrying business situation,Live content is illegal and irregularities.Secondly,in the aspect of legal risk,the webcast platform in China has the legal risks of breach of contract,infringement of portrait rights,invasion of privacy,infringement of copyright and even constitute crime.Finally,in terms of supervision,there are some issues such as unclear subject of supervision,low level of supervision law,lack of punishment,insufficient supervision and lack of unified supervision system.According to the advanced experience of the United States,the European Union and South Korea on the supervision of webcast platform,we are looking forward to put some solution strategies to improve the supervision of the webcast platform in China.First of all,by establishing unified and applicable administrative regulations,perfecting the supporting department rules and formulating relevant industry standards,we can build up the legal system of the webcast platform supervision in China.Secondly,it is clear that the Ministry of culture should be a unified administrative regulatory agencies,and paying attention to the self-regulatory function of the local industry associations,so as to form a regulatory thinking with "industry regulation as the main form and government supervision as a supplement".Finally,we establish the legal supervision rules of China's webcast platform by establishing the main body access and exit mechanism of the webcast platform,the operation process of the webcast platform,the internal risk supervision measures and the supervision measures of the external environment.
