Study Of The Application Of The Blockchain Electronic Evidence Of Civil Litigation

The essence of the measures,including deepening judicial reform,constructing intelligent courts,establishing the platform of deposition of electronic evidence,and applying the technology of blockchain to the field of electronic evidence,is to reform on judicial system in the orbit of information according to the requirements of the central committee of the Chinese Communist Party.With the coming age of 5G communication,the electronic evidence tends to be widely used eventually.Traditionally,electronic evidence is stored in electronic form,which is easy to change and not safe enough.In contrast to the traditional storage of evidence,the blockchain itself is characterized by decentralization,distributed deposition,and impossibility to be changed,etc.The application of the blockchain technology to the deposition of electronic evidence and records can make electronic evidence stable and impossible to change,which will completely change the disadvantages of traditional deposition.For instance,the authenticity of traditional electronic evidence is hard to identify and they are seldom accepted by the court.However,the application of the blockchain electronic evidence is still in a primary stage of exploration in China at present.In addition,the supporting laws and regulations have not been formed and there is still much insufficiency in the links of deposition,preservation,and identification,etc.Therefore,in order to establish the modernized judicial system,improve the court’s capability of adjudication,and complete the construction of intelligent courts,it is necessary to further improve relevant procedure,strictly administer the platform for deposing the blockchain electronic evidence.In this way,the blockchain electronic evidence can be utilized in civil proceedings better,the reform of judicial system can be deepened further,the efficiency of litigation can be raised,and the digital justice can be realized to serve the masses better.
