Commutation is one of the important contents of the penalty execution system in China.Moreover,commutation as an important way to reform criminals,its role is self-evident.Commutation system mainly refers to a system of actively reforming criminals by changing the type of punishment and reducing the term of sentence in the process of penalty execution.The system is mainly through the transformation of good criminals,in order to play a role.Commutation of punishment can effectively encourage criminals to reform and promote social harmony and stability.Fair and just commutation is an important guarantee for the legitimate rights and interests of criminals and an important measure to help them return to society.At present,in the process of judicial practice in China,although the commutation system is relatively perfect,there are many problems in the actual operation.In the face of these problems,we can make up for the loopholes in the process of commutation through the combination of scientific measures and the reality,and better solve various problems in the practice of commutation.Through the investigation and practice of the intermediate people’s Court of s city for many times,the author finds out the deficiencies in the commutation process of the court of S City,and makes a comparative analysis,so as to put forward reasonable suggestions.This paper mainly takes the basic situation of commutation in S City Intermediate People’s court as the research sample,and effectively collates and analyzes the research situation in a multi-level and comprehensive way.Through data integration and chart display,the most intuitive way to show the commutation situation of S City Court.Although the research samples are complex and diverse,the research content reflects the local characteristics of s city.In this process,the author will introduce the data content and chart information in detail,so as to better find the problems existing in the commutation process of S City Court.And a simple summary of the reasons for the problems,according to the existing problems,through the combination of research practice and commutation theory,to develop a scientific and effective strategy,and put forward feasible suggestions.The author divides it into four parts: first,the first part is the introduction,mainly writing the reason and significance of the topic,as well as the current research status of commutation at home and abroad.The second part is to sort out the commutation data of S City Court from 2016 to 2019,and summarize the characteristics and trends of commutation cases through data and charts.Use data to explain potential problems,and use charts to directly reflect problems.Integrate the information of the questionnaire and analyze the main problems.Finally,we use the actual commutation case data to illustrate the possible problems.The third part,through the above data,points out the problems existing in commutation in S City Court,and carefully analyzes the main reasons.The fourth part,on the basis of finding the problem,combined with the reality of S City Court,formulate reasonable,effective,scientific countermeasures,in order to better solve the problems in commutation.
